`CASE MANAGEMENT CONFERENCE

`Plaintiff/Counter-Defendant/Third-PartyPlaintiff,TUTOR PERINI BUILDING CORP.

`("TPBC"), by and through its undersignedcounsel,hereby files this Motion for Case Management
`
`Conference, and as grounds therefore,states:
`
`1.
`
`This is a complex construction action concerning allegeddefects in the Dalmar
`
`Hotel in Fort Lauderdale (the"Project").This case was consolidated with 12 other related cases
`
`concerningthe Project.
`
`2.
`
`Between May 22,2023, and June 16,2023, the Court conducted a trial of all claims
`
`between 299 N. Federal Master, LLC (the"Owner") and TPBC. The Owner and TPBC entered
`
`into a confidential settlement agreement priorto the Court enteringits ruling.
`
`3.
`
`The confidential settlement agreement between the Owner and TPBC resolved all
`
`claims that those two partieshad againstone another related to the Project.
`
`4.
`
`Additionally,TPBC and several subcontractor third-partydefendants entered into
`
`settlement agreements which resolved the claims between TPBC and each of those third-party
`
`defendants.
`
`5.
`
`TPBC's claims against the other third-partydefendants (the "Non-Settling
`
`Subcontractors")remain.
`

`On October 19, 2023, the Court held a Status Conference with TPBC and the Non-
`
`SettlingSubcontractors to discuss the remainingclaims.
`
`7.
`
`On November 2,2023, the Court entered an Order to Submit Proposed Amended
`
`Case Management Order for a trial beginningin the third quarter of 2024. See Exhibit "A," Order
`
`for CMO. In the Order for CMO the Court instructed TPBC to submit a Proposed Amended Case
`
`Management Order within 30 days ofthe Order. See id.
`
`

`
`On November 9,2023, the Court entered a separate Order SettingTrial,Pretrial
`
`Instructions,and Calendar Call,settingtrial to begin July 1,2024. See Exhibit "B," Order Setting
`
`Trial.
`

`
`On November 20, 2024, the undersigned submitted a Proposed Amended Case
`
`Management Order pursuant to the Order for CMO. See Exhibit "C," Proposed Amended CMO.
`

`
`The Proposed CMO was never entered in this case.
`
`TPBC requests a Case Management Conference to discuss the aforementioned
`
`Orders and how to proceedwith the remaining claims,includingwhen trial will occur.
`
`WHEREFORE, Tutor Perini Building Corp. requests that the Court hold a Case
`
`Management Conference to discuss how the remaining claims will proceed.

`consolidated for purposes of trial,and all remaining claims between TPBC and the subcontractors

`2. The case involving 299 N FEDERAL MASTER, LLC's claims against SOL-ARCH, INC.,
`previouslyconsolidated,is no longer consolidated and will not be tried with the claims between TPBC
`
`and the subcontractors.

`3. The partiesshall submit within 30 days of this signed Order a Proposed Amended Case
`
`Management Order, which providesthat trial will be set to begin duringthe third quarter of 2024.

`Counsel shall keep apprisedof the status and progress
`of the cases in front of them on the docket.

`THIS CAUSE is set for Jury/Non-Jury Trial before JUDGE JACK TUTER in
`Courtroom 17150, Broward County Courthouse, 201 S.E. 6th Street, Fort
`Lauderdale, Florida. The time standards set forth herein are directives
`established by Florida Supreme Court Administrative Order AOSC20-23,
`Amendment 12 (April13,2021) and Florida Rule of General Practice and
`Judicial Administration 2.250, which have set a time frame for the completion
`of complex civil cases within twenty-four (24) months.
`However, the court
`recognizes that certain unique cases may have cause for reasonable delay
`beyond this time period. The parties and their counsel are on notice that due
`to the nature of the cases and the potentiallength of trial,cases in the Complex
`
`Civil Division are set for an approximate trial date following the completion of
`the preceding case. Counsel are ordered to monitor the progress of the
`preceding case to ensure their preparation to immediately commence trial
`when the case is called to trial. COUNSEL ARE ADVISED DUE TO THE
`LENGTH OF CASES IN THIS DIVISION ANY CIRCUIT JUDGE WHO
`BECOMES AVAILABLE MAY TRY THIS CASE. AS SUCH EACH CASE ON
`THIS CALENDAR SHALL BE READY FOR TRIAL WHEN THE CASE IS

`NO LATER THAN SIXTY (60) DAYS PRIOR TO TRIAL - MEDICAL EVALUATIONS: All
`medical evaluations and other examinations pursuant to Fla. R. Civ. P. 1.360 shall have
`been completed.

`NO LATER THAN FORTY- FIVE (45) DAYS PRIOR TO TRIAL: All final discoveryshall
`have been initiated.
`
`TEN (10) DAYS PRIOR TO TRIAL: All pretrialdiscovery, including discovery
`depositions or testimony preserved by video of witnesses or experts to be used at trial,
`shall have been completed. Any motions in Iimine, shall be filed and served on opposing
`counsel.

`AT THE TIME OF THE ABOVE NOTICED CALENDAR CALL, the Joint Pretrial Stipulation
`must be completed and timely filed with the Clerk with a copy provided to the
