`The Plaintiff sues the Defendants and alleges:
`
`1. This is a summary action for eviction from real property in DUVAL
`
`County, Florida.
`
`2. Plaintiff. HISHYAR ISMAIL, (“Plaintiff”) is the president of a corporation,
`
`with a power of attorney, from the owner of land and improvements commonly
`
`known as 1 1092 Joel Street Jacksonville, Florida 322 18. See Exhibit “A”.
`
`(“The
`
`Property”) .
`
`3. The Defendant, PATRICIA DENISE BROWN, as tenant, has possession
`
`of said Property under a Lease Agreement entered into with Plaintiff on
`
`September 16, 2020.
`
`See attached hereto as Exhibit Composite “B”.
`
`(the
`
`“Lease”).
`
`4. Pursuant to the Lease agreement at paragraph 8, Plaintiffs provided
`
`notice to Defendant of their intentions to perform and inspection and make
`
`repairs to the premises. Despite providing reasonable notice to Defendant, on
`

`Compliance / Notice of Termination of Lease. Prior thereto on April 28, 2021,
`
`Plaintiff provided Defendant with an opportunity to cure previous non
`
`compliances with the rental agreement See composite exhibit
`
`“C”
`
`(the
`
`“Notices”) 1.
`
`5. Defendant has a duty under the Lease to allow inspections based upon
`
`reasonable notice. There is an implied covenant in good faith and fair dealing
`
`in every contract.
`
`Insurance Concepts and Design, Inc. v. Healthplan Services,
`
`Inc., 785 S.2d 1232 (Fla. 4th DCA 2001).
`
`6. To be sure, access to this rental property, is not only permitted by the lease,
`
`it is permitted by Florida Law. Fla. Stat. § 83.532 ; see also Exhibit B. (Lease
`
`agreement at paragraph 8).
`
`7. Plaintiff has effectively terminated the lease agreement by providing proper
`
`notice, under the law.
`
`8. Defendant has failed to VACATE the premises despite being provided Notice
`
`that the lease is being terminated by operation of law and having been provided
`
`with an opportunity to cure her previous lease violations and is otherwise in
`
`breach of the Lease.
`
`1 Prior to the Opportunity to Cure Notice provided on April 28, 202 1, there had
`been 3 Notices for Inspection.
`2 § 83.53 provides independent grounds to the landlord for entry of the
`property and dwelling. The very fact that Plaintiff was denied access by
`Defendant constituted a breach of the agreement as well as good faith
`requirements of the statute See Ludovici v. Lopez, 10 Fla. L. Weekly Supp. 800a
`(1 1th Cir. Judge King).

`9. Defendant is moreover liable, for double rent which allows a landlord to collect
`
`reasonable damages for the use and occupation of property when not held by
`
`agreement See § 83.07; see also Lincoln Oldsmobile, Inc. 1). Branch, 574 So.2d
`
`1111, 1113 (Fla. 2d DCA 1990) (stating that a landlord’s mutually exclusive
`
`remedies for holdover tenant are double rent, a specific amount of continuing
`
`rent, or possession of the property plus damages.)
`
`10. Here, Defendant’s rent is $1,100.00 per month, though now that she is a
`
`holdover tenant after being duly noticed of the lease violation $2,200.00 per
`
`month and for an amount pro rata amount based upon 16 days from May 15,
`
`2021 through May 31, 2021, at a daily rate of $70.96 for May’s balance or
`
`$, 135.48 for the days remaining after she held over and failed to vacate.
`
`11. From June 1, 2021 through the days she remains in possession, then
`
`holdover rental amount is $2,200.00.
`
`12. Further, Plaintiff is damaged to the extent that his property becomes
`
`progressively worse each day that passes as a direct result of Defendant’s refusal
`
`to comply with the agreement and the law by not allowing inspections and
`
`repairs to the commode and roof and what ever else repairs need to be made.
`
`13. Plaintiff has retained a property management company as its agent, Ronaldo
`
`Nourdelin, to manage this rental unit, including entering contracts and collecting
`
`rents from Defendants.
`
`WHEREFORE, Plaintiff demands summary procedure and final judgment for
`
`possession of the property against the Defendant.
