`On 11/03/2024 at approximately 2236 | observed a black male wearing a black hoodie and black sweat pants, later identified as
`Jerry Mccant (Suspect), leaving 1548 Kings Rd.(Prime Time Food Store). The Suspect then crossed the 1300 block of Rushing St.
`close to,a 45 degree angle not at a 90 degree angle, or the shortest possible routein violation of Florida State Statute 316.130(12).
`| activated the emergency equipment on myclearly markedpatrol vehicle and stoppeddirectly in front of the Suspect and
`another unknown black male. Both the Suspect and the unknownindividual continued to walk into the roadway East on the 1500
`block ofKingsRd.in violation of Florida State Statute 316.130(3).
`Asl stepped outof mypatrol vehicle and shouted at both of the males to stop walking. The unknown male turned aroundand
`walked towards the sidewalk on Kings Rd. As | was steppingout of mypatrol vehicle the Suspect turned, looked at me, and then
`began to flee on foot, running East across Kings Rd.

`It should be noted thatat this time the Suspect was lawfully detained due to two pedestrian violations, and was notfree to leave.
`Additionally, it should be noted that the Suspect beganto flee on a busystretch of Kings Rd. with several vehicles in the
`roadway causing a substantial safety risk to the Suspect and officers present.
`Officer L. Bible (#77762), and | began to pursue to the Suspect onfoot, while giving him loud verbal commandsto stop. As the
`Suspectcontinued to run Eastbound| noticed the Suspect throwingseveralitemsout of his pockets as he ran. Additionally, as
`the Suspect continued to run he kepthis right arm at a 45 degree angle with his hand remaining at his waistband. Due to my
`trainingjand experience the waistbandis a common place where weaponsare concealed. The Suspect continued to East on
`Kings Rd. passing WhitnerSt., then beganto turn North in an openlot. The Suspect then lost his footing in the damp grass and
`quickly regained his footing while maintaining his right hand nearhis waistband.
`At that time fearing that the Suspect was possibly armed, along with fleeing in a busy road for approximately one and a half
`blocks, which created a substantial safety hazard,| activated my Department Issued Conducted Energy Weapon (CEW). After the
`Suspectregainedhis footing, he continued to resist by fleeing. | deployed thefirst bay of my CEW (Serial #X48422609), but did
`not achieve NeuromuscularIncapacitation (NMI). The Suspect continued fleeing. Seeing that NMI was not achieved, | immediately
`deployed the second by of my CEW (Serial #X48422600). NMI Was achieved and the Suspectfell to the ground. I observed a
`plastic baggie and what appearedto be a prescriptionpill bottle in the Suspect's right hand. I then gave the Suspect loud verbal
`commaidsto show mehis hands. The Suspect rolled over and threw theitemsin his right hand.

`At that time | seized the Suspect's right arm androlled him over to his stomach. The Suspect then continuedto actively resist by:
`tensing|his arms, and concealed his left arm underhis body near his waistband. The Suspect's left hand was concealedin hi wi

`waistbandin the samearea that,he had been concealing his right arm earlier. Not Knowingif the Suspectstill hada concealed .
`weapon I delivered several knee strikes to the Suspect's left arm and abdomen areawhile maintaining control of his rightarm.

`gave the Suspect loud verbal commandsto stop resisting and to showhis hands. I.was then able to overcome the Suspect's -
`active physical resistance and place hisleft arm behind his back. Officer J. Fincher (#83606) placed the Suspect into handcuffs"
`and placed him in the back seatof a marked patrolvehicle.

`Officer Fincher then located a small sandwich style baggie containing several smaller-baggies with a white powder substance
`(Property #1), along with a prescription bottle containing several baggies containing a white powder substance. Both the items
`were located in the direction, where | had observed the Suspect throw the items that were in his right hand. The prescription
`bottle andtheplastic baggie were both completely dry, although it had rained earlier in the evening and the ground where they
`were recovered was wet. Additionally, inside of the prescription bottle was a single white pill with the markings "10/325" on one
`side and "M523" on the other (Property #2). ThePill was identified as Acetaminophen and Oxycodoneusingpill identifier.

`| retraced the Suspect's path and located a packageofcigars, house keys, and a wallet with the Suspect's Florida Identification
`Card, and several denominations of loose cash.
`
`Engine and Rescue #7 responded and medically cleared the Suspect. The Suspect did not complain of any injury. Officer D.
`Taylor (#81280) removed the CEW probes remainingin the Suspect. | then placed the probes into my empty CEW cartridges and .
`disposedofit properly.
`Officer Fincher and Officer Bible conducted a field test of the white powder substance, whichfield tested presumptive positive
`for presence of Fentanyl. A total ofseven baggies containing white powder substance wascollected. Aninitial total field weight
`of 9.20 gramsof the white powder substance wasobtained.
`J read the Suspect his Miranda Warningsvia Agency Issued Card. The Suspectverbally stated that he understood his Warnings.
`Post Miranda, the Suspect stated that he never saw the police lights on my markedpatrolvehicle, or heard metell him to stop.
`Whenasked whyhewasrunning, the Suspect stated that he was out running for exercise as he normally does. The Suspect then
`invoked his right to remain silent.
`
`After invoking his right to remain silent, the Suspect continued to make spontaneous utterances without me questioning him.
`The Suspect askedif | had picked up his wallet and house keys. The Suspect continued to claim ownership of several of the
`items thatfell out of his pocket, but vehemently claimed he never had any narcotics in his possession.
`
`It should be noted that the Trafficking amountof fentanylis four grams. The Suspect possessed over double the trafficking
`amount, that were separated out in seven individual baggies; additionally, five of the seven packages were approximately the
`sameweight. The Suspect also possessedsignificant smaller denominationbills in separate folds totaling $494 (Property #3).
`Due to mytraining and experienceall of these factors are consistent withillicit sales of narcotics.
`The listed property was entered into the Property Room as Evidence.

`The Suspectwascitedfor failing to cross at the shortest possible route (Citatlon #AKJD1ME), and walking iin the roadway where
`
`a sidewalk was provided (Citation 7AKJD1NE).

`The Suspect was arrested and transported to the PTDF withoutfurther incident.
