`COMES NOW the Plaintiff, SERGUEY ENRIQUE SEGURA TRISTA, individually by

`and through the undersigned counsel, and sues the Defendant, RANDY ALFREDO LAY
`
`PEREZ in support thereof alleges:
`

`This is an action for damages in excess of FIFTY THOUSAND DOLLARS ($50,000.00),
`
`exclusive of interest, attorney’s fees, if any, and costs.
`
`2.
`
`At all times material and relevant hereto, the Plaintiff, SERGUEY ENRIQUE SEGURA
`
`TRISTA was and is a resident of Miami Dade County, Florida, and otherwise sui juris.
`
`3.
`
` At all times material hereto, the Defendant, RANDY ALFREDO LAY PEREZ was and is
`
`a resident of Miami-Dade County, and otherwise sui juris.
`
`4.
`
`Venue is proper in Miami Dade County, Florida as the accident occurred in Miami Dade
`
`County, Florida.
`

`FACTS COMMON TO ALL COUNTS
`
`5.
`
`On or about May 24, 2020, the Plaintiff, was driving a 2011 Jeep, vehicle license number
`
`CNZK22 Traveling south bound on west 11th Avenue in Miami Dade County.
`

`On or about May 24, 2020, the Defendant, driving a 2020 Volkswagen vehicle license
`
`number KCGV35 was traveling west bound on west 33 Street approaching west 11th Avenue in
`
`Miami Dade County, Florida.
`
`7.
`
`Defendant, RANDY ALFREDO LAY PEREZ failed to use due care by failing to stop at a
`
`stop sign and yielding the right of way.
`
`8.
`
`Defendant, RANDY ALFREDO LAY PEREZ, was cited for running stop sign pursuant to
`
`Florida Statute 316.123(2)(a).
`
`9.
`
`That this action is outside the purview of the Florida Automobile Reparations Act, as the
`
`Plaintiff has sustained permanent injuries within a reasonable degree of medical probability.
`

`
`The Defendant, RANDY ALFREDO LAY PEREZ, is concealing their whereabouts,
`
`purposefully and intentionally evading service of process. Plaintiff is seeking substitute service
`
`pursuant to §48.171 and §48.161 of Florida Statutes. (See attached Return of Non-Service and
`
`Affidavit of Due Diligence (“Exhibit A”)
`

`COUNT I
`
`NEGLIGENCE AS TO DEFENDANT
`
`Plaintiff reaffirms and re-alleges paragraphs one (1) through ten (10) as is fully set forth

`herein.
`

`At all times material hereto, the Defendant operated and/or maintained his motor vehicle
`
`so carelessly, recklessly, and negligently so as to cause a collision with Plaintiff’s vehicle.
`
`13.
`
`Defendant had a duty to operate the vehicle safely and in accordance with the laws of
`
`Florida, which he failed to do.
`
`14.
`
`The direct and proximate result of the Defendant negligent failure to maintain and/or
`
`properly operate the motor vehicle, the Plaintiff has suffered personal, permanent injuries.
`

`As a direct and proximate result of the Defendant’s negligence, the Plaintiff has suffered
`
`bodily injury, resulting pain and suffering, physical impairment, disability, mental anguish, loss of
`
`capacity for the enjoyment of life experienced in the past and to be experienced in the future,
`
`medical and nursing care and treatment, loss of earnings, and loss of an ability to earn money.
`
`These said losses are either permanent and/or continuing in nature and the Plaintiff will suffer such
`
`losses in the future.
`
`WHEREFORE, Plaintiff, SERGUEY ENRIQUE SEGURA TRISTA, demands Judgment
`
`for damages against the Defendant, RANDY ALFREDO LAY PEREZ and all such other relief,
`
`as this Honorable Court deems just and equitable. The Plaintiff demands trial by jury of all issues
`
`so triable as of right by a jury.
