`On June 6th, 2087 at 2300 hours,
`I Deputy Sheriff Thomas Boggs was on official
`law enforcement duty in Orange County (Sector 4)
`in uniform
`and in an agency vehicle with official markings/insignia when I observed the following: While conducting a waking patrol of the Royal
`Inn,
`located at 7101 South Orange Blossom Trail,
`I observed a Silver Ford Mustang running near the laundry area on the North West corner of the
`
`business. As I approached | observed a Hispanic male,
`later
`identified as Bacilio Martinez,
`(Defendant) exit
`the laundry area, walk to the
`Mustang, get
`in the driver's seat, and drive towards the South end of the property. This seemed suspicious. As I made my way to the South
`end of the property I observed Bacilio walking away from the Mustang. Once Bacilio was away from the vehicle I ran the VIN number using
`NCIC/FCIC and it was determined that
`the vehicle was reported stolen out of Orange County.
`I gave the description of Bacilio and last known
`direction of Bacilio to other units in the area as I waited at
`the vehicle. Approximately 5 minutes later ] observed Bacilio walking back towards
`me.
`I
`immediately placed him in handcuffs.
`I read Bacilio his Miranda Rights from my agency issued Miranda rights card.
`I asked Bacilio if he
`understood his rights. He stated that he understood and would also speak to me. Bacilio stated that he was driving the Mustang but
`that he
`borrowed it
`from someone named, "Alex" for $20. Bacilio stated that he had never met, "Alex" before tonight and he did not know that
`the
`vehicle had been reported stolen.
`In Bacilio's back pack a clear plastic baggie containing a green leafy substance that
`| know from training
`and experience to be Marijuana. A sample of the green leafy substance was tested with an agency issued test kit
`for marijuana. The sample
`tested presumptive positive for marijuana. The content of the baggie had a weight of 7.4Grams and has been submitted into evidence.
`Because of the presumptive positive test Bacilio will be charged with F.S.S. 893.13(6)(B) Possession of Cannabis <20 Grams.
`In Bacilio's
`backpack and front
`left pocket
`I discovered 32 $100USD bills and 26$20USD bills. These bills were replica bills but were very real
`looking
`bills. Combined with their authentic look and amount of bills which a reasonable person would not carry around normally Secret Service was
`notified.
`I spoke with Special Agent McLaurin. Through the discussion we determined the best statute for the possession of that many bills I
`have probable cause to charge Bacilio F.S.S. 832.08-1 Possess Counterfiet
`-10 or More Certain Bills Because of me seeing Bacilio driving the
`Mustang, his own admission of driving the Mustang, and the key to the vehicle being found in his possession I have probable cause to
`charge Bacilio with F.S.S, 812.014(2)(C)(6) Grand Theft 3rd Degree (Motor Vehicle) The vehicle was towed by Ace Wrecker The vehicle has
`been removed from NCIC/FCIC as stolen by Teletype. Bacilio was transported to the Orange County Jail without
`incident. The incident was
`recorded by BWC.
