`This cause coming on to be heard on Monday, August 14, 2019, on an application for
`variances submitted by Carol and Jerard Muszik, and after having heard testimony of the
`Building Official of the Town of Redington Shores, Bruce Cooper, as well as the testimony of
`Chad Lubke, the owner's agent, Leslee Coppock (17819 Lee Avenue) and Vince Campisi (134-
`178th Avenue West), and having received into evidence a variance application dated April 26,
`2019 together with a receipt for $1,000.00 from the Town of Redington Shores to Carol Muszik
`in payment of the applicationfee, a letter dated July 8, 2019 from Building Official Bruce Cooper
`to the affected property ownersl a letter dated August 13, 2019 from Chad Lubke to Building
`
`Official Bruce Cooper, an aerial of Lee Avenue reflecting the Coastal Construction Control Line,
`a copy of Objective 2.3 of the Town of Redington Shores Comprehensive Plan, an aerial photo
`
`of 17822 Lee Avenue, a street view photo of 17822 Lee Avenue, a copy of a cover letter from
`the undersigned dated November 11, 2016 addressed to the Town Clerk as well as an Order
`
`Granting Application for Variances for 17814 Lee Avenue dated November 11, 2016, and being
`otherwise advised in the premises, the undersigned Special Magistrate does make the following
`specific findings of fact:
`
`1. The property located at 17822 Lee Avenue, Redington Shores, Florida, is owned by
`Carol and Jerard Muszik.

`2. The property has a land use designation of single family residential and a zoning
`designation of Commercial Tourist Facilities ("CTF").
`In its Application for Variance, the Property Owners are seeking the following
`variances:
`a. Reduce the front yard setback from 25 feet to 9 feet; and
`b. Reduce the north side yard setback from 10 feet to 5 feet; and
`c. Reduce the south side yard setback from 10 feet to 5 feet; and
`d. Reduce the rear yard setback from Coastal Construction Control Line (CCCL)
`from 25 feet to 18 feet.
`
`4. Section 90-127 of the Land Development Regulations of the Town of Redington
`Shores gives the Special Magistrate the authority to authorize a variance "as will not
`be contrary to the public interest when, owing to special conditions, a Iiteral
`enforcement of the provisions of Ithe Codel would result in unnecessary and undue
`hardship," and when the requested variance meets all of the following requirements:
`(a) That special conditions and circumstances exist which are peculiar to the land,
`structure or building involved, and which are not applicable to other lands,
`structures or buildings in the same zoning district;
`That special conditions and circumstances do not result from the actions of the
`applicant;
`That granting the variance requested will not confer on the applicant any special
`privilege that is denied by this Part 5 to other lands, buildings or structures in the
`same zoning district;
`(d) That Iiteral interpretation of the provisions of this Part 5 would deprive the
`applicant to rights commonly enjoyed by other property owners in the same
`zoning district under the terms of this Part 5, and would work unnecessary and

`(e) That the variance granted is the minimum variance that will make possible the

`reasonable use of the land, building or structure; and

`involved or otherwise detrimental to the public welfare.

`5. The property is not rectangular in shape but parallelogram and, therefore, is not
`positioned perpendicular to Lee Avenue. Special conditions and circumstances do
`exist on this property which are not applicable to other land structures or buildings in
`the same zoning district, as the vast majority of single family homes in the Town of
`Redington Shores are built on rectangular lots. Rectangular lots provide full use of
`the buildable lot area for structurefootprints. The unusual parallelogramshape of the
`subject property results in disproportionate loss of buildable area.
`6. The special conditions and circumstances do not result from the actions of the
`Property Owners, as the parallelogram shape of the property existed prior to the
`purchase by the current property owners.
`7. The granting of the front and side yard setback variances requested will not confer on
`the applicant any special privilege that is denied to other lands, buildings and
`structures in the same zoning district. The property is located in the Commercial
`Tourist Facilities district which is a mixed use area with a variety of commercial and
`residential construction. The requested front yard and side yard setbacks are similar
`to other homes on Lee Avenue. The requested rear yard setback would confer upon
`the applicant a special privilege that is denied to other lands, building and structures
`in the same zoning district.
`8. The literal interpretation of the provisions of Part 5 of the Code would deprive the
`applicants of rights commonly enjoyed by other lands, buildings or structures in the
`same zoning district, as it relates to the front and side yard setbacks. The proposed
`variances to the front and side yard setbacks required by the Code allows the
`Property Owners to utilize the property in a manner similar to other structures on Lee
`Avenue.
`The proposed variance to the rear yard would violate the Town's
`Comprehensive Plan Objective 2.3.
`9. The front and side yard setback variances granted are the minimum variances that
`will make possible the reasonable use of the land, building and structure.
`10. That the granting of the front and side yard setback variances requested are in
`harmony with the general intent of the Code and are reflective of the development
`pattern in the commercial tourist facilityzoning district.
`11. The rear yard setback variance being requested, if granted, would violate Objective
`2.3 and Policy 2.3.3 of the Town's Comprehensive Plan. Policy 2.3.3 provides:

`Recognizing that the entire community is vulnerable to hurricanes
`and other tropical events, the Town shall continue to strictly enforce
`all appropriate federal, State, and local coastal construction codes,
`coastal

`requirements, special CCCL facility

`restrictions, and floodplain management regulations.

`Based on the foregoing, it is ORDERED:
`1. That the front yard setback set forth in Section 90-110C shall be varied to allow for a
`front yard setback of 9 feet.
`2. That the north side yard setback set forth in Section 90-110C shall be varied to allow
`for a north side yard setback of 5 feet.
`3. That the south side yard setback set forth in Section 90-110C shall be varied to allow
`for a south side yard setback of 5 feet.

`This letter is to address page four of the varianceapplication: Variance Criteria- Section
`90-127B (1 through 6). The questions from the section and our response follows.
`1. That special conditions and circumstances exist which are peculiar to the land,
`structure or building involved and which are not applicable to other lands,
`structures or buildings in the same zoning district.
`The subjectproperty is extremely narrow measuring 42.3' across the angled front. For
`context, lots adjacent to North and South ofthe subject property are 63.4' wide, which is
`50% wider, or 21.1' more in width. The home adjacent and to the North of the subject
`property, 17824 Lee Ave, is 63.4' across the angled front and received a variance in
`recent years, even with its 50% more width. The propertyalso is not rectangular shaped,
`but parallelogram, and is not positioned perpendicularto Lee Ave. The overwhelming
`majority of single family homes in Redington Shores are built on rectangular lots, which
`provide full use ofthe buildable lot area. This unusual parallelogramshape results in
`disproportionate loss ofbuildable area.

`2. That the special conditions and circumstances do not result from the actions ofthe
`applicant.
`The applicant has not created any special conditions or circumstances, the narrow lot
`width and parallelogramshape existed prior to the purchase by the current property
`
`owners.

`3. That granting the variance requestedwill not confer on the applicant any special
`privilege that is denied by this Part 5 to other lands, buildings or structures in the
`same zoning district.

`17814 Lee Ave is 48' wide, or 5.7' wider than the subject property. It was granted 5
