`"A. SUMMARY NARRATIVE:
`Khalil Lindsey is currently charged with Felony Information (22-04569CF) which is a 3 count charge of Delinquent in
`Possession of a Firearm, Possession of Cocaine, and Felony Possession of Marijuana.
`Count One alleges that on April 20th, 2022, the said youth was in possession of a firearm Without a lawful reason. The youth
`was previously charged as a delinquent in possession of a firearm back in December, 2019.
`Count- 2 of the information charges Ifllalil Lindsey with Possession of Cocaine. It is alleged that on April 20, 2022, the said
`youth was in felony possession of cocaine without a lawful reason.
`Count 3 of the information charges Khalil Lindsey with Possession of Marijuana. It is alleged that on April 20, 2022, the said
`youth was in possession of felony marijuana without a lawful reason.
`At the time of the offense, Khalil was residing with his maternal grandmother, Diane Vinson in the city of Saint Petersburg. In
`2018, his mother passed away from cancer. There appeared to be a deterioration in his behavior after the loss of his mother.
`The youth temporarily resided with an uncle in Hillsborough County for a few months, but the placement broke down due to
`behavioral issues with the youth and was subsequently placed with his maternal grandmother. His father resides in Tampa, but
`due to prior physical abuse by his father, he was not allowed to live with him. The relationship between Khalil and his father
`was always strained due to the abuse. His behavior at home has always been inconsistent. Mrs. Vinson has indicated that she
`had limited control and that the youth primarily did not follow rules and was non-compliant with curfew. She also indicated
`that the youth was often disrespecfl'ul and always displayed a poor attitude. She became the primary caretaker due to no other
`family members wanting to take on the responsibility for caring for the youth. His biological parents were never married.
`The grandmother previously indicated that the youth primarily showed no emotion after the death of his mother and did not
`want to participate in any type of grief counseling. She believes that his criminal activities was how he coped With the loss of his
`mother.
`There is an extensive history of involvement with the Department of Children and Families. The youth was never in foster care,
`but resided with several relatives while growing up.
`Mrs. Vinson did indicate that the youth was not engaged in structured activities after the death of his mother. He did previously
`play sports in the community and» had some association with positive peers. Khalil has no formal history of employment. The
`youth has also been documented as a Prolific Juvenile Offender.
`Academically, Khalil's last history of school was while in residential commitment programs. After completion of his first
`residential commitment program, he was placed at the STRIVE Academy for academics and counseling services. Khalil
`struggled with attendance due to being placed on virtual learning at the time of COVID 19 restrictions back in the year 2020.
`He has been clinically di
`agnosed with Attention Deficit Hyperactive Disorder. The youth had a history of referrals for insubordination, disrespect, and
`fighting. Khalil has not recently been enrolled in any other type of educational setting.
`Khalil has no known major medical issues at this time. He is not currently taking any prescribed medications. The youth also
`has no formal history of being Baker-Acted.

`UPERVISIONIPLACEMENT ADJUSTMENT:
`0n December 4, 2018, Khalil Lindsey was referred to the Juvenile Diversion Alternative Program (JDAP) for petition #18-
`1882DL. Khalil Lindsey was referred to the State Attorney's Office on June 27, 2019, for non-compliance with services.
`Khalil was initially placed on DJJ Probation for 12 months on June 27, 2019, on case #18-1882DL. Iflmlil was court ordered to
`cooperate with the following sanctions: Curfew of 7pm-5:30am, No Contact with Victim/Co-defendants, and School Rule.
`During this term of probation, Khalil failed to comply with curfew requirements. Curfew checks were repeatedly conducted by
`law enforcement, with Khalil failing to be present for the majority of the checks. Khalil also incurred new charges while on
`probation.
`On December 10, 2019, Khalil was committed to the Department of Juvenile Justice on the following case number(s): 19-
`02467DL, 19-02469DL, 19-01865DL, 19-01603DL Seq. 1-2, 19—01261DL, and 19-00848DL. Khalil was admitted to Orange
`Youth Academy on January 2, 2020, and successfully completed the program on August 24, 2020.
`0n August 24, 2020, Khalil was placed on six months Post—Commitment Probation and court ordered the following sanctions:
`Pay any restitution deemed necessary, Curfew of 8pm-5:30am, Cooperate with recommended counseling, and Cooperate with
`Strive Academy.
`Khalil remained non-compliant with his court ordered sanctions as Khalil was removed from Strive due to non-compliance.
`Khalil also incurred new charges during this time.
`On November l7, 2020, Khalil was continued on Post-Commitment Probation for a New-Law Violation of Probation. Khalil
`was court ordered to cooperate with the previous recommended sanctions from August 24, 2020. Khalil was once again non-
`compliant with his court ordered sanctions as he incurred new charges. 0n December 29, 2020, Khalil was direct committed on
`the following case numbefls): 20-01617dl, 20-01823dl, and 20-01807dl Seq. 1-2 to a High—Risk residential commitment program.
`The youth was subsequently placed at the St. John‘s Youth Academy on February 2, 2021. His adjustment was satisfactory and
`he was directly released from St. John's Youth Academy on February 9, 2022.

`JUSTIFICATION (NARRATIVE):
`The following powers of disposition were considered in determining Calvin's appropriateness for juvenile sanctions:
`(1) The seriousness of the offense to the community and whether the community would best be protected by juvenile or
`adult sanctions.
`The charges are serious in nature and the youth has an extensive history of similar charges.
`(2) Whether the offenses were committed in an aggressive, violent, premeditated, or willful manner.
`The offense showed willful premeditated intent to have in his possession a firearm and illegal substances. The youth was
`fully aware that he did not have permission to have firearms in his possession.
`(3)Whether offenses wcrc against property or the greater weight given to offense against person especially if personal
`injury resulted.
`The offenses are property related and there was a potential for bodily harm had the weapon been used in the commission of
`a crime.
`(4) The sophistication and maturity of the offender.
`The youth was not given a comprehensive evaluation for the pending charge before the court. The youth was evaluated in
`April, 2019, by Dr. Lori Bourgard and he was diagnosed with Average Intelligence. The youth has had issues with school
`attendance and academic performance. The youth is 17 and not currently employed.
`(5) The record and previous history of the offender.
`The youth has a prior history of judicial diversion, probation, and 2 residential commitment programs: a Non-Secure and a
`High-Risk. The youth is currently on intake status with the Department. The youth will be 18 soon.

`(6) The prospects for adequate protection of the public and the likelihood of deterrence and reasonable rehabilitation of the
`offender if assigned to services and facilities with the Department.
`A Community Assessment Tool instrument was administered in reference to the pending allegation. This instrument helps
`the Department identify needs and ensure referrals are made to appropriate agencies. Khalil scored as a high—risk to
`reofl‘end. He has a previously diagnosis of Conduct Disorder, Adjustment Disorder, with disturbance of conduct and
`Attention Deficit Hyperactivity Disorder, Combined type by history.
`(7) Whether the Department of Juvenile Justice has appropriate programs, facilities, and services immediately available.
`The Department would recommend the youth be considered for adult sanctions due to his extensive prior history with the
`Department as well as prior placements in residential commitment programs.
`(8) Whether adult sanctions would provide more appropriate punishment and deterrence to further violations of the law
`than imposition of juvenile sanctions.
`The Department is recommending adult sanctions. The Department has reviewed the eight powers of disposition and has
`taken into consideration youth's age, maturity, prior record, seriousness of the allegations, mental health, and community
`safety. The assigned Juvenile Probation Officer conducted a Pre—Staffing on May 23, 2022. Present were Juvenile Probation
`Officer, Jeffery Williams and Juvenile Probation Officer Supervisor, Candy Jaynes. The recommendation was for the
`youth to be considered for adult sanctions.
`The assigned JPO conducted a Pre-Staffing with the Chief Probation Officer, Melissa Fuller on May 23, 2022. Due to the
`youth's prior history, and seriousness of the charges, the recommendation was for the youth to be considered for adult
`sanctions.
`At this time to the charges of Delinquent in Possession of a Firearm (F2), Possession of Cocaine (F3), and Possession of
`Marijuana (F3), the youth did not enter a plea however the court did order the Department of Juvenile Justice to determine
`if the youth should be considered for adult sanctions versus juvenile sanctions and to consider a possible disposition should
`the youth enter a plea or be found guilty of case #22-04569CF as charged in the information filed by the State Attorney.
`The Department has determined that, if the youth i's found guilty or enters a plea to case #22-04569CF, as charged,
`Delinquent in Possession of a Firearm (F2), Possession of Cocaine (F3), and Possession of Marijuana (F3), the Department
`would consider a recommendation for adult sanctions.
