`Pursuant to the Court’s September 23, 2022 Order Appointing Philip Favro As Special

`Master (“Special Master Appointment Order”),1 the Special Master hereby provides the following
`
`REPORT which memorializes the services he has rendered from June 01, 2023 through June 30,
`
`2023 (hereinafter the “Relevant Time Period”) in the above-captioned litigation (“Action”).
`

`During the Relevant Time Period, I have spent a total of 11.25 hours on the Action.
`
`The services I have rendered on this matter generally include the following: Review
`
`and analysis of orders, related court filings, and the Parties’ respective positions regarding the
`
`email dispute that “has so bitterly divided counsel” for Deal Genius and O2COOL as memorialized
`
`in the Special Master Appointment Order and the Court’s September 21, 2022 minute order
`
`(“9/21/22 Minute Order”),2 along with possible spoliation issues arising from the deletion of
`
`emails belonging to a certain former employee of Plaintiff and Counterclaim-Defendant Deal
`
`

`Genius, LLC (“Deal Genius”); communications with the Court and counsel for Deal Genius and
`
`Defendant and Counterclaimant O2COOL, LLC (“O2COOL”) regarding the email dispute and
`
`spoliation issues and related matters; review and analysis of transcripts from court hearings and
`
`conferences between the Parties; legal research and analysis; and preparation of an order
`
`addressing the Parties’ dispute over elusion testing.
`

`Pursuant to the Court’s Minute Order dated October 10, 2022 (“10/10/22 Minute
`
`Order”), my billable rate for this matter is $595 per hour.3 This rate reflects a reasonable and
`
`prevailing rate for special master compensation in the locality for this type of service. At the
`
`billable rate of $595 per hour, the total cost of the services I have rendered during the Relevant
`
`Time Period is $6,693.75.
`

`Accordingly, the Special Master requests that payment in the amount of $6,693.75
`
`be remitted to Philip Favro and Innovative Driven within 30 days of the filing date of this
`
`REPORT. In accordance with the Special Master Appointment Order and the 10/10/22 Minute
`
`Order, Deal Genius and O2COOL shall respectively remit payment for fifty (50%) percent—
`
`$3,346.88—of the $6,693.75 sum.
