`Depositions of Defendants. In support of this response, Defendants state the following:
`1. On November 23, 2020, Plaintiff filed a Motion for Depositions of Defendants. No such
`motion needed be filed With the Cofirt. No narhed defefidalnt is an incaréeréted individual
`and thus, Plaintiff ddes figt need thé Céurt’s- fiermissiofi f0 fiotice théir deposition.
`
`2. The Plaintiff is, however, required to incur the cost of a court reporter to swear in the
`Witness, properly fecord and transcribe the depositions. See Ind. R. Trial P. 30 (The
`officer before whom the deposition is to be taken shall put the witness on oath and shall
`personally, or by someone acting under his direction and in his presence, record the
`testimony of the Witness. The testimony shall be taken stenographically or recorded by
`
`any other means designated in accordance with subdivision (B)(4) of This rule. If
`requested by one of the parties, the testimony shall be transcribed.)
`3. Defendant objects to the recording of a deposition by a simple recording device, as
`requested by Pléintifi‘. First, depoISition b3} recording device énly does nét provide an

`Comes now Defendants, by counsel, and pursuant t0 Indiana Trial Rule 37 (C),
`respectfillly moves this Court to deem Defendants” Requests for Admissions No. 3, 4, 5, 6 and 8,
`
`for the following reasons:
`1. A copy of the Defendants’ Requests for Admissions No. 3,4,5,6, and 8, with the
`Plaintiff s December 3, 2019 Responses, are attached hereto as Ex. A.
`2. Pursuant to Trial Rule 36, a party may serve upon any other party a written request
`for the admission ofthe truth of any matters within The scope ofRule 26(B).
`3. The matter is admitted, unless within 30 day after service, the party to Whom the
`request is directed serves his answer or objection addressed to the matter. TR. 36(A).

`If any objection is made, it must specifically deny the matter set forth in the request
`
`for admission.
`
`4. In responding to Requests for Admissions No. 3, _4, 5, 6 and 8, the Plaintiffprovided

`no-responsive answers, failing to admit or deny the entire factual proposition set forth
`in each of the Defendants’ Requests. The Admission being requested are relevant

`because they are probative evidence on the issues ofwhether the Plaintiff actually
`exhaust all Available administrative remedies for his claims as required under the

`Prison Litigation Reform Act, and his damages claims and the time period during
`
`which they accrued.
`5. Ifthe Court determines that an answer does not comply with the requirements of this
`rule, it may order the matter is admitted. TR. 36(A). A matter admitted under this
`rule is conclusively established, unless the court on a motion permits withdrawal of
`the admission. TR 26(B).
`WEREFORE, Defendants respectfully request the Court deem as admitted, Defendants’
`Requests for Admissions No. 3,4,5,6 and 8.
