`
`Thank you for your joint letter of October 6, 2016, with Chairman Tim Murphy,
`Vice Chainnan Peter‘Viscl0sky; and 27 other members of the Congressional Steel
`Caucus concerning the Commission’s Investigation No. 337-TA-1002, Certain
`Carbon and/illoy Steel Products, under section 337 of the Tariff Act of l930 (19
`U.S.C. § 1337). You indicate that industry stakeholders in the investigation have
`expressed concern to the Caucus about pending motions before the Comrnissiotfs
`presiding administrative law judge (ALI) to terminate two of the three claims
`asserted in the investigation before discovery has fully progressed. You -also
`indicate that members of the Caucus were of the understanding that these motions
`Weremade after the Commission initially determined that the case should move
`forward on all claims until discovery and testimony have been completed.
`
`The motions at issue relate to cornplainanfs claims regarding: (1) a conspiracy to
`fix prices and control output and export volumes, the threat or effect of which is to
`restrain or monopolize trade and commerce in the United States (antitrust claim),
`and (2) false designation of origin or manufacturer, the threat or effect of which is
`to destroy or substantially injure an industry in the United States (false marking
`claim). The ALI granted the motion to terminate the antitrust claim on November
`l4, 2016. Her Initial Determination (Order No. 38) on that motion is before the
`Commission, and the Commission is currently scheduled to make a decision on
`Whether to review it by December 15, 2016. The motion to terminate the false
`marking clairn is still pending before the ALI.
