`The Office of Unfair Import Investigations (“OUII”) respectfully submits this response to
`
`the March 19, 2018, Commission Notice requesting written submissions on the issues of remedy,
`
`the public interest, and bonding with respect to Complainant U.S. Steel Corporation’s
`
`(“Complainant” or “U.S. Steel”) false designation of origin claims against certain defaulting
`
`Respondents (“Commission Notice”).
`
`Counsel for Complainant has informed OUII that Complainant will not be requesting
`
`relief against the defaulting Respondents in this Investigation. Under the circumstances – and
`
`particularly given that the importation of products affected by the relevant alleged unfair acts is
`
`already prohibited by other provisions of law – OUII does not recommend that a remedial order
`
`be issued.
`
`In the event that the Commission determines to consider a remedy, OUII respectfully
`
`submits as Attachment A hereto a proposed Limited Exclusion Order. See Commission Notice
`
`at 3. OUII has provided a copy of its proposed exclusion order to the Intellectual Property
`
`Rights Branch of U.S. Customs and Border Protection (“Customs”). Customs proposed certain
`
`changes to clarify Customs’ enforcement authority. OUII has incorporated these changes in its
`
`proposed order.

`The Commission has found Benxi Steel (Group) Co. Ltd.; Benxi Iron and Steel (Group)
`
`International Economic and Trading Co. Ltd.; Shandong Iron and Steel Group Co. Ltd.;
`
`Shandong Iron and Steel Co., Ltd.; Jigang Hong Kong Holdings Co., Ltd.; Jinan Steel
`
`International Trade Co. Ltd.; Tianjin Tiangang Guanye Co., Ltd.; Wuxi Sunny Xin Rui Science
`
`and Technology Co., Ltd.; Taian JNC Industrial Co., Ltd.; EQ Metal (Shanghai) Co., Ltd.;
`
`Kunshan Xinbei International Trade Co., Ltd.; Tianjin Xinhai Trade Co., Ltd.; Tianjin Xinlianxin
`
`Steel Pipe Co. Ltd.; Tianjin Xinyue Industrial and Trade Co., Ltd.; and Xian Linkun Materials
`
`(Steel Pipe Supplies) Co., Ltd. (collectively, the “Defaulting Respondents”) in default for failing
`
`to respond to a Notice of Institution of Investigation and a Complaint alleging a violation of
`
`section 337 of the Tariff Act of 1930, as amended, 19 U.S.C. § 1337, with respect to the
`
`unlawful importation and sale of certain carbon and alloy steel products by reason of false
`
`designation of origin or manufacturer, the threat or effect of which is to destroy or substantially
`
`injure an industry in the United States.
`
`
`
`Having reviewed the record in this investigation, including the written submissions of the
`
`parties, the Commission has made its determination on the issues of remedy, the public interest,
`
`
`
`

`
`and bonding. The Commission has determined that the appropriate form of relief is a limited
`
`exclusion order prohibiting the unlicensed entry of covered carbon and alloy steel products that
`
`are manufactured abroad by or on behalf of, or imported by or on behalf of, the Defaulting
`
`Respondents or any of their affiliated companies, parents, subsidiaries, licensees, or other related
`
`business entities, or their successors or assigns.
`
`The Commission has determined that the public interest factors enumerated in 19 U.S.C.
`
`§ 1337(g) do not preclude issuance of the limited exclusion order, and that the bond during the
`
`Presidential review period shall be in the amount of 100% of the entered value for all covered
`
`carbon and alloy steel products during the period of Presidential review.
`
`Accordingly, the Commission hereby ORDERS that:
`
`1. Carbon and alloy steel products that are imported into the United States using false
`
`designations of origin or manufacturer and that are manufactured abroad by or on behalf of, or
`
`are imported by or on behalf of the Defaulting Respondents, or any of their affiliated companies,
`
`parents, subsidiaries, or other related business entities, or their successors or assigns, are
`
`excluded from entry for consumption into the United States, entry for consumption from a
`
`foreign-trade zone, or withdrawal from a warehouse for consumption, except as provided by law.
`
`
`
`2. Notwithstanding paragraph 1 of this Order, the aforesaid carbon and alloy steel
`
`products are entitled to entry for consumption into the United States, entry for consumption from
`
`a foreign-trade zone, or withdrawal from a warehouse for consumption, under bond in the
`
`amount of 100% of entered value of such articles pursuant to subsection (j) of section 337 of the
`
`Tariff Act of 1930, as amended, 19 U.S.C. § 1337(j), and the Presidential Memorandum for the
`
`United States Trade Representative of July 21, 2005 (70 Fed. Reg. 43251), from the day after
`
`this Order is received by the United States Trade Representative and until such time as the
`
`
`
`

`
`United States Trade Representative notifies the Commission that this action is approved or
`
`disapproved but, in any event, not later than sixty (60) days after the date of receipt of this Order.
`
`Note, however, that this provision does not exempt seizure of infringing articles under the
`
`trademark and copyright laws enforced by U.S. Customs and Border Protection (CBP), most
`
`notably 19 U.S.C. § 1526(e) and 19 U.S.C. § 1595a(c)(2)(C) in connection with 15 U.S.C.
`
`§ 1124, 17 U.S.C. § 506, and 18 U.S.C. §§ 2318 and 2320. The entries of the subject carbon and
`
`alloy steel products are also not exempt from the provisions 19 U.S.C. § 1304 (marking of
`
`imported articles and containers) and enforcement thereof, and 19 U.S.C. § 1517 (procedures for
`
`investigating claims of evasion of antidumping and countervailing duty orders) and enforcement
`
`thereof.
`
`3. In accordance with 19 U.S.C. § 1337(l), the provisions of this Order shall not apply to
`
`carbon and alloy steel products that are imported by and for the use of the United States, or
`
`imported for, and to be used for, the United States with the authorization or consent of the
`
`Government.
`
`4. At the discretion of CBP and pursuant to procedures it establishes, persons seeking to
`
`import carbon and alloy steel products that are potentially subject to this Order may be required
`
`to certify that they are familiar with the terms of this Order, that they have made appropriate
`
`inquiry, and thereupon state that, to the best of their knowledge and belief, the products being
`
`imported are not excluded from entry under paragraph 1 of this Order. At its discretion, CBP
`
`may require persons who have provided the certification described in this paragraph to furnish
`
`such records or analyses as it deems necessary to substantiate the certification.
`
`
`
`5. The Commission may modify this Order in accordance with the procedures
`
`described in Rule 210.76 of the Commission’s Rules of Practice and Procedure, 19 C.F.R.
`

`6. The Secretary shall serve copies of this Order upon each party of record in this
`
`investigation and upon CBP.
`
`7. Notice of this Order shall be published in the Federal Register.
