`AN EXTENSION OF TIME TO RESPOND TO AND/OR MOVE TO
`QUASH OR LIMIT COMPLAINANTS’ SUBPOENAS
`
`Pursuant to Commission Rules 210.15 and 210.32 and the Ground Rule 1.10.3, non-party
`
`Lakeview Metal, Inc. (“Lakeview”) moves the Court to extend the deadline for responding to
`
`and/or moving to quash or limit the subpoenas duces tecum and ad testificandum (“the
`
`Subpoenas”) served on it by Complainants Metglas, Inc., and Hitachi Metals, Ltd.
`
`(“Complainants”) on December 5, 2017.
`
`Pursuant to the Subpoenas, Lakeview must produce documents by December 15, 2017
`
`(or at another mutually agreed upon time), and must present a witness for deposition on
`
`December 21, 2017 (or at another mutually agreed upon time). Moreover, the Subpoenas require
`
`that any motion to limit or quash shall be filed within ten (10) days after receipt of the
`
`Subpoenas, which were served on December 5, 2017, making the original deadline December
`
`15, 2017. Lakeview requests an extension to December 29, 2017 to respond. There is good
`
`cause to grant the requested extension.
`
`Counsel for Lakeview has begun conferring with counsel for Complainants concerning
`
`the scope of Complainants’ Subpoenas and Lakeview’s efforts to comply. Given the broad
`
`scope and sensitivity of the subject matter of the Subpoenas, Lakeview informed Complainants
`
`that Lakeview needs a more specific scope and certain protections in order meet its obligations
`
`
`
`

`under the Subpoenas. Counsel for Lakeview and Complainants continue to negotiate in good
`
`faith a reasonable scope and method for responding to the requests for production. To allow
`
`negotiations to continue and to potentially avoid a motion to limit or quash the Subpoenas,
`
`counsel for Lakeview and Complainants have agreed, subject to approval by the Administrative
`
`Law Judge, that Lakeview be given until December 29, 2017 to respond to the subpoenas.
`
`In light of this agreement, Lakeview respectfully requests that the Administrative Law
`
`Judge extend the deadline for Lakeview to move to limit or quash the Subpoenas, should such a
`
`motion be necessary, to December 29, 2017, and extend the deadline for producing documents
`
`and a deposition to a mutually agreed upon date.
`
`Pursuant to Ground Rule 5.4, counsel for Lakeview contacted counsel for Advanced
`
`Technology & Materials., AT&M International Trading Co., Ltd., CISRI International Trading
`
`Co., Ltd., Beijing ZLJG Amorphous Technology Co., Ltd., and Qingdao Yunlu Energy
`
`Technology Co, Ltd., and the parties have agreed that they do not oppose the motion.
