`Respondents SK hynix Inc., SK hynix America Inc., and SK hynix memory solutions

`Inc. (collectively, “SK hynix”) hereby respectfully request leave to file separate confidential
`
`and public exhibit lists out of time. Complainant Netlist, Inc. (“Netlist”) and the Office of
`
`Unfair Import Investigations (“Staff”) do not oppose the requested relief.
`
`Counsel for SK hynix filed SK hynix’s final exhibit lists for SK hynix’s RX, RDX and
`
`RPX exhibits, which contained listings of both the confidential and public exhibits yesterday
`
`(the due date) before 5:15 pm. However, Respondents seek leave to file separate confidential
`
`and public final exhibit lists, which were mistakenly omitted during the filing process.
`
`Counsel for SK hynix promptly notified Netlist and the Staff at 7:00 pm last night of the
`
`omission, requested consent to file this motion unopposed, and thereafter served copies of the
`
`separate confidential and public exhibit lists on the parties.
`
`SK hynix’s confidential RX, RDX and RPX exhibit lists are attached hereto as Exhibits
`
`A-1, A-2 and A-3, respectively. SK hynix’s public RX and RDX exhibit lists are attached
`
`hereto as Exhibits B-1 and B-2, respectively. There are no public RPX exhibits, so there is no
`
`

`public RPX exhibit list. After receiving the positions of Netlist and the Staff, SK hynix
`
`promptly filed this motion for leave.
`
`Good cause exists to grant this request. The separate confidential and public exhibit
`
`lists include listings of the same exhibits as listed in SK hynix’s timely-filed combined exhibit
`
`lists, but the separate lists will assist the ITC in processing and tracking SK hynix’s exhibits.
`
`No party opposes this relief, and no party was or could be prejudiced by permitting the filing
`
`of the separate confidential and public exhibit lists, which were served last night.
`
`For the reasons set forth above, SK hynix respectfully requests that the CALJ grant this
`
`unopposed motion for leave to file SK hynix’s confidential and public RX, RDX and RPX
`
`exhibit lists attached hereto as Exhibits A-1, A-2, A-3, B-1 and B-2.
