`

`
`CERTAIN HUMAN MILK
`OLIGOSACCHARIDES AND METHODS
`OF PRODUCING THE SAME

`
`ORDER NO. 9:
`
`NON-PARTY
`OF
`MOTION
`UNOPPOSED
`GRANTING
`FRIESLANDCAMPINA INGREDIENTS NORTH AMERICA,
`INC.
`FOR A SECOND EXTENSION OF TIME TO MOVE TO LIMIT,
`QUASH, OR OTHERWISE RESPOND TO SUBPOENA DUCES
`TECUM AND AD TESTIFICANDUM
`
`(September 4, 2018)
`
`On August 31, 2018, non-party FrieslandCampina Ingredients North America,
`
`Inc.
`
`(“FCINA”) moved (1120-O05) to extend the deadline to respondto and/or move to limit or quash
`
`the subpoenas duces tecum and ad testlficandum served by Respondent Jennewein Biotechnologie
`
`GmbH. FCINA requests that it receive an extension up to and including September ll, 2018.
`
`(Mot. at 1-2.) FCINA explains:
`
`FCINA and its outside counsel requires additional time to continue
`their investigation of the document requests contained in the subpoena
`duces tecum. FCINA also seeks the additional time to negotiate with
`Respondent to reach mutual agreement on the scope of the document
`requests and deposition.
`FCINA and Respondent have had
`discussions and FCINA is hopeful
`that through these discussions,
`FCINA and Respondent can come to a mutual understanding
`regarding the scope of FClNA’s response to the subpoenas and
`therefore avoid motion practice.
`If, however, negotiations fail, an
`extension of time will allow FCINA to draft motions to limit or quash
`the subpoenas. Since there are still approximately two months left in
`fact discovery, the requested extension of time will not cause any
`prejudice to Respondent.
`l
`
`(Id. at -2.) FCINA represents that Respondent Jennewein Biotechnologie GmbH, Complainant
`
`Glycosyn LLC, and the Commission Investigative Staff do not oppose the motion. (Id. at 1.)
`
`-1.

`
