`SUMMARY: We, the U.S. Fish and
`Wildlife Service, have received
`applications for permits to conduct
`activities intended to enhance the
`
`propagation or survival of endangered
`or threatened species under the
`Endangered Species Act. We invite the
`public and local, State, Tribal, and
`Federal agencies to comment on these
`applications. Before issuing any of the
`requested permits, we will take into
`consideration any information that we
`receive during the public comment
`period.

`SUPPLEMENTARY INFORMATION: We, the
`U.S. Fish and Wildlife Service, invite
`the public to comment on applications
`for permits under section 10(a)(1)(A) of
`the Endangered Species Act of 1973, as
`amended (ESA; 16 U.S.C. 1531 et seq.).
`The requested permits would allow the
`applicants to conduct activities
`intended to promote recovery of species
`that are listed as endangered or
`threatened under the ESA.
`
`Background
`
`With some exceptions, the ESA
`prohibits activities that constitute take
`of listed species unless a Federal permit
`is issued that allows such activity. The
`ESA’s definition of “take” includes such
`
`activities as pursuing, harassing,
`trapping, capturing, or collecting in
`addition to hunting, shooting, harming,
`wounding, or killing.
`A recovery permit issued by us under
`section 10(a)(1)(A) of the ESA
`authorizes the permittee to conduct
`activities with endangered or threatened
`species for scientific purposes that
`promote recovery or for enhancement of
`propagation or survival of the species.
`Our regulations implementing section
`10(a)(1)(A) for these permits are found
`at 50 CFR 17.22 for endangered wildlife
`species, 50 CFR 17.32 for threatened
`wildlife species, 50 CFR 17.62 for
`endangered plant species, and 50 CFR
`17.72 for threatened plant species.

`SUPPLEMENTARY INFORMATION: Section
`337 of the Tariff Act of 1930, as
`amended, 19 U.S.C. 1337 (“Section
`337”), provides that if the Commission
`finds a violation it shall exclude the
`articles concerned from the United
`
`States unless after considering the
`public interest factors listed in 19 U.S.C.
`1337(d)(1), it finds such articles should
`not be prevented from entry.
`The Commission is soliciting
`comments on public interest issues
`raised by the recommended relief
`should the Commission find a violation,
`specifically whether the Commission
`should issue a limited exclusion order
`
`(“LEO”) against certain human milk
`oligosaccharides that are imported, sold
`for importation, and/or sold after
`importation by respondent Iennewein
`Biotechnologie GmbH of
`Rheinbreitbach, Germany.
`The Commission is interested in
`
`further development of the record on
`the public interest in this investigation.
`Accordingly, parties are to file public
`interest submissions pursuant to 19 CFR
`210.50(a)(4). In addition, members of
`the public are hereby invited to file
`submissions of no more than five (5)
`pages, inclusive of attachments,
`concerning the public interest in light of
`the administrative law judge’s
`Recommended Determination on
`
`Remedy and Bonding issued in this
`investigation on September 9, 2019.
`Comments should address whether
`
`issuance of an LEO in this investigation,
`should the Commission find a violation,
`would affect the public health and
`
`welfare in the United States,
`competitive conditions in the United
`States economy, the production of like
`or directly competitive articles in the
`United States, or United States
`consumers.

`In particular, the Commission is
`interested in comments that:
`(1) Explain how the articles
`potentially subject to the recommended
`orders are used in the United States;
`(ii) Identify any public health, safety,
`or welfare concerns in the United States
`
`relating to the recommended orders;
`(iii) Identify like or directly
`competitive articles that complainant,
`their licensees, or third parties make in
`the United States which could replace
`the subject articles if they were to be
`excluded;
`[iv] Indicate whether complainant,
`complainant’s licensees, and/or third
`party suppliers have the capacity to
`replace the volume of articles
`potentially subject to the recommended
`exclusion order and/or a cease and
`
`desist order within a commercially
`reasonable time; and
`(v) Explain how the LED would
`impact consumers in the United States.
