`IMPORTATION STIPULATION BETWEEN COMPLAINANT INVT SPE LLC AND
`RESPONDENTS HTC CORP. AND HTC AMERICA, INC.
`
`Complainant INVT SPE LLC (“Complainant” or “INVT”) and Respondents HTC
`
`Corporation and HTC America, Inc. (collectively “HTC”) hereby agree and stipulate as follows:
`
`1.
`
`This stipulation and the information it contains will be used only in the instant
`
`Investigation and any action arising therefrom, and shall not be binding on any party for any
`
`other purpose or in any other administrative or judicial proceeding, and shall not be used for any
`
`other purpose, including as evidence, in any such proceeding. This Stipulation shall not be
`
`construed as an admission of infringement of any claim of the patents at issue in the
`
`Investigation or that any of the Relevant HTC Products are “articles that . . . infringe a valid and
`
`enforceable United States patent” according to 19 U.S.C. 1337(a)(1)(B). Further, nothing in this
`
`Stipulation shall be construed as an admission of validity or enforceability of the patents at issue
`
`in this Investigation, or an admission that INVT is entitled to any relief under 19 U.S.C. 1337
`
`2.
`
`HTC America, Inc. has imported and imports into the United States, within the
`
`meaning of 19 U.S.C. § 1337, at least one unit of the U12+ and the Exodus 1. HTC America,
`
`Inc. has imported into the United States, within the meaning of 19 U.S.C. § 1337, at least one
`
`

`unit of the U11 and U11 Life.
`
`3.
`
`HTC America, Inc. has sold within the United States after importation, within the
`
`meaning of 19 U.S.C. § 1337, at least one unit of each of the following accused communications
`
`devices: U11; U11 Life; U12+; and the Exodus 1.
`
`4.
`
`HTC Corporation has sold for importation into the United States, within the
`
`meaning of 19 U.S.C. § 1337, at least one unit of each of the following accused communications
`
`devices: U11; U11 Life; U12+; and the Exodus 1.
`
`5.
`
`For the purposes of this Investigation, the HTC Respondents do not and will not
`
`dispute INVT’s contention that HTC America, Inc. imported into the United States and/or sold
`
`within the United States after importation, and/or that HTC Corporation sold for importation, at
`
`least one unit of the following cellular communications devices: U11, U11 Life; U12+; and the
`
`Exodus 1 (the “Relevant HTC Products”), and that the importation requirements of 19 U.S.C. §
`
`1337(a)(l)(B) and (a)(l)(C) are met as to each of the Relevant HTC Products.
`

`
`Given Respondents' representations in this Stipulation, INVT agrees that it will
`
`not seek further discovery or testimony from HTC regarding the importation process of the
`
`Relevant HTC Products in this Investigation, or for the Desire 520; Desire 526; Desire 530;
`
`Desire 625; Desire 610; Desire 612; One Mini 2; One Remix; Desire Eye; One (M8); One (M8)
`
`for Windows; One (E8); Desire 510; Desire 626; Desire One A9; Bolt; One M9; 10; U Ultra;
`
`and/or Nexus 9, including U.S. Customs or shipping documents or HTC’s distributors and
`
`resellers. However, nothing in this Stipulation shall impinge each party’s right or ability to obtain
`
`discovery and testimony regarding any other issue relevant to a party’s claim or defense in this
`
`Investigation, nor shall it impinge HTC’s rights to object to such discovery and testimony.
