`Rovi intends to call the following fact witnesses to testify at the evidentiary hearing. The

`proposed brief outline of testimony is based on the best information Rovi has to date regarding

`the scope of this Investigation and Comcast’s contentions. The description of proposed testimony

`
`Samir Armaly is a Strategic IP Advisor to Rovi, and formerly the Executive Vice

`President of IP and Licensing, located at 2233 N. Ontario St. #200, Burbank, CA, 91504. Mr.

`Armaly will testify generally regarding Rovi’s history and negotiations with Comcast, including
`
`Comcast’s explicit notice of the ’445 and ’528 Patents, and Comcast’s refusal to renew its
`
`license to Rovi’s Guidance portfolio, notwithstanding the exclusion and cease and desist orders
`
`issued in the 1001 and 1103 Investigations.

`Research, heading that firm’s national intellectual property practice. Mr. Iyer has extensive

`ESTIMATED DATE AND LENGTH OF WITNESSES
`
`According to Order No. 3, the hearing is scheduled for six days (January 21-24, 27-28,
`
`2020). Comcast has taken the untenable position in this Investigation that every witness (other
`
`than a corporate designee) should be called live – even if the sole purpose of their testimony is to
`
`address one short statement in a prior deposition in which both parties were present. In Rovi’s
`
`view, Comcast’s position will result in a longer and highly inefficient hearing as Rovi is forced
`
`to call several witnesses (Comcast and third-party) to introduce testimony already set forth in
`
`their respective deposition transcripts. Rovi’s Amended Tentative Witness List explicitly
`
`reserved the right to call Comcast and third-party employees, Doc No. 688504 at 13-18 (Sept.
