`The United States International Trade Commission (“Commission”) has instituted the
`
`above-captioned investigation under Section 337 of the Tariff Act of 1930 as amended (19
`
`U.S.C. § 1337), based upon the allegations contained in the Amended Complaint filed by Juul
`
`Labs, Inc. (“JLI”), which alleges violations of section 337 by various respondents, including
`
`Respondent Texas E. Cigarette d/b/a EZFumes (“EZFumes”), based upon the importation into
`
`the United States, the sale for importation, and/or the sale within the United States after
`
`importation of certain vaporizer cartridges and components by reason of infringement of U.S.
`
`Design Patent Nos. D842,536 (“the ’D536 patent”); D858,870 (“the ’D870 patent”); D858,869
`
`(“the ’D869 patent”); and D858,868 (“the ’D868 patent”) (collectively, the “Asserted Design
`
`Patents”).
`
`Respondent EZFumes has executed a Consent Order Stipulation in which it agrees to the
`
`entry of this Consent Order and to all waivers and other provisions as required by the
`
`Commission’s Rules of Practice and Procedure. JLI and EZFumes have filed a Joint Motion to
`
`Terminate the Investigation as to EZFumes based on Consent Order.

`
`The United States International Trade Commission (“Commission”) has instituted the
`
`above-captioned investigation under Section 337 of the Tariff Act of 1930 as amended (19
`
`U.S.C. § 1337), based upon the allegations contained in the Amended Complaint filed by Juul
`
`Labs, Inc. (“JLI”), which alleges violations of section 337 by various respondents, including
`
`Respondent Texas E. Cigarette d/b/a EZFumes (“EZFumes”), based upon the importation into
`
`the United States, the sale for importation, and/or the sale within the United States after
`
`importation of certain vaporizer cartridges and components by reason of infringement of U.S.
`
`Design Patent Nos. D842,536 (“the ’D536 patent”); D858,870 (“the ’D870 patent”); D858,869
`
`(“the ’D869 patent”); and D858,868 (“the ’D868 patent”) (collectively, the “Asserted Design
`
`Patents”).
`
`Respondent EZFumes has executed a Consent Order Stipulation in which it agrees to the
`
`entry of this Consent Order and to all waivers and other provisions as required by the
`
`Commission’s Rules of Practice and Procedure. JLI and EZFumes have filed a Joint Motion to
`
`Terminate the Investigation as to EZFumes based on Consent Order.

`IT IS HEREBY ORDERED THAT:
`
`1.
`
`Pursuant to 19 C.F.R. § 210.21(c)(4)(i):
`
`a.
`
`Complainant in this Investigation is JLI, a privately held corporation that
`
`exists under the laws of the state of Delaware, with its principal place of business at 560
`
`20th Street, San Francisco, California 94107;
`
`b.
`
`Respondent covered by this Consent Order is EZFumes, a privately-held
`
`corporation having an address of 2900 Highway 121, STE 165, Bedford, Texas 76021;
`
`c.
`
`the “Subject Articles” are “vaporizer cartridges and components thereof
`
`containing a space to hold a vaporizable liquid substance that can be vaporized after the
`
`cartridge is inserted into a vaporizer device” that infringe the Asserted Design Patents
`
`(hereinafter defined); and
`
`d.
`
`the “Asserted Design Patents” are the ’D536 patent; the ’D870 patent; the
`
`’D869 patent; and the ’D868 patent.
`
`2.

`JLI’s Complaint in this Investigation alleges “on information and belief, [that] the
`
`Accused Products are imported, sold for importation, and/or sold after importation by or on
`
`behalf of” EZFumes and “that infringe one or more of the Asserted [Design] Patents.”
`
`3.
`
`Pursuant to 19 C.F.R. § 210.21(c)(4)(ii), EZFumes has executed a Consent Order
`
`Stipulation.
`
`4.
`
`Pursuant to 19 C.F.R. § 210.21(c)(4)(iii), EZFumes shall not sell for importation,
`
`import, or sell after importation the Subject Articles, directly or indirectly, and shall not aid, abet,
`
`encourage, participate in, or induce the sale for importation, the importation, or the sale after
`
`importation except under consent or license from JLI.

`EZFumes does not have any existing U.S. inventories of vaporizer cartridges and
`
`components thereof.
`
`6.
`
`Pursuant to 19 C.F.R. § 210.21(c)(4)(v), EZFumes shall cease and desist from
`
`importing and distributing Subject Articles that infringe the Asserted Design Patents in the
`
`United States.
`
`7.
`
`Pursuant to 19 C.F.R. § 210.21(c)(4)(vi), EZFumes shall be precluded from
`
`seeking judicial review or otherwise challenging or contesting the validity of the Consent Order.
`
`8.
`
`Pursuant to 19 C.F.R. § 210.21(c)(4)(vii), EZFumes shall cooperate with and shall
`
`not seek to impede by litigation or other means the Commission’s efforts to gather information
`
`under subpart I of the Commission’s Rules of Practice and Procedure, 19 C.F.R. § 210.
`

`Pursuant to 19 C.F.R. § 210.21(c)(4)(viii), EZFumes and its officers, directors,
`
`employees, agents, and any entity or individual acting on its behalf and with its authority shall
`
`not seek to challenge the validity or enforceability of any Asserted Design Patents in any
`
`administrative or judicial proceeding to enforce the Consent Order.
`

`
`Pursuant to 19 C.F.R. § 210.21(c)(4)(ix), when any of the Asserted Design
`
`Patents expires, the Consent Order shall become null and void as to such.
`

`
`Pursuant to 19 C.F.R. § 210.21(c)(4)(x), if any claim of the Asserted Design
`
`Patents is held invalid or unenforceable by a court or agency of competent jurisdiction or if any
`
`article has been found or adjudicated not to infringe the asserted right in a final decision, no
`
`longer subject to appeal, this Consent Order shall become null and void as to such invalid or
`
`unenforceable claim or adjudicated article.

`Pursuant to 19 C.F.R. § 210.21(c)(4)(xi), the Commission has in rem jurisdiction
`
`over the Subject Articles, in personam jurisdiction over EZFumes for purposes of this Consent
`
`Order, and subject matter jurisdiction over this Investigation.
`
`13.
`
`Pursuant to 19 C.F.R. § 210.21(c)(4)(xii), this Investigation is hereby terminated
`
`with respect to EZFumes; provided, however, that enforcement, modification, or revocation of
`
`this Consent Order shall be carried out pursuant to Subpart I of the Commission’s Rules of
`
`Practice and Procedure, 19 C.F.R. § 210.
`
