`Pursuant to Commission Rule 210.5 and 210.15, and Ground Rules 3.1 and 3.6,
`

`Complainant US Synthetic (“Complainant”) respectfully moves this Court to amend the
`
`Protective Order entered on December 22, 2020 (Order No. 1), to allow all parties to conduct
`
`testing of certain polycrystalline diamond compact (“PDC”) samples produced as confidential
`
`business information (“CBI”) in this investigation using in-house technicians employed by the
`
`parties. No party opposes the proposed modification to the Protective Order.
`
`As detailed in the attached memorandum, allowing limited sample testing by a specified
`
`and pre-approved number of party employees is appropriate under 19 C.F.R. § 201.6 to permit
`
`all parties to conduct infringement analysis and allow the Commission to perform its statutory
`
`function of resolving the merits.
`
`Accordingly, US Synthetic respectfully requests that the Administrative Law Judge
`
`amend the Protective Order to include the Proposed First Addendum to Order No. 1 Regarding
`
`the Testing of Confidential Samples and Treatment of Test Results, attached hereto as Exhibit A.
`

`Pursuant to Ground Rule 3.2, US Synthetic notified Respondents at least two (2) business
`
`days before filing this motion, and no Respondent opposes entry of the protective order
`
`addendum proposed in this motion.

`
`Pursuant to Ground Rule 3.6, US Synthetic requests that this unopposed motion receive
`
`expedited treatment. The parties’ have negotiated over the course of two months in a five-month
`
`fact discovery period regarding the heightened protection clauses and have reached agreement on
`
`the attached proposed addendum.

`COMPLAINANT US SYNTHETIC’S MEMORANDUM IN SUPPORT OF ITS
`UNOPPOSED MOTION TO AMEND THE PROTECTIVE ORDER
`
`Pursuant to Commission Rules 210.5, 210.15, and 210.34; Ground Rule 3.1; and Order
`
`
`
`No. 1, Complainant US Synthetic (“Complainant”) hereby submits this memorandum in support
`
`of its unopposed motion to amend the Protective Order (Order No. 1) to include the provisions
`
`set forth in Exhibit A to Complainant US Synthetic’s Unopposed Motion to Amend the
`
`Protective Order and Request for Expedited Treatment. The amendment to the protective order
`
`will govern the testing of certain PDC samples produced as CBI in this investigation by party
`
`employees and the handling of the results of such testing.
`
`Good cause exists for this modification to the Protective Order because the parties wish
`
`to allow a limited number of designated party employees to conduct testing on PDC samples.
`
`Much of the equipment needed for testing products is industry specific. The parties may have
`
`such equipment, but traditional third-party labs do not. The COVID pandemic has further
`
`complicated testing. The parties have reached a resolution allowing each party to include in-
`
`house technicians under the Protective Order with special conditions. This resolution is reflected
`
`in the Proposed First Addendum to Order No. 1 Regarding the Testing of Confidential Samples
`
`and Treatment of Test Results set forth in Exhibit A. The addendum is necessary so that evidence
`
`

`can be obtained by the parties and weighed by the commission. However, the evidence will be
`
`handled in a way that does not harm to the competitive position of the person, firm, partnership,
`
`corporation, or other organization from which the information was obtained.
`
`ALJs have previously recognized that good cause exists to modify protective orders when
`
`the parties agree to permit limited access to CBI by in-house employees. See, e.g., Certain
`
`Condensers, Parts Thereof And Products Containing Same, Including Air Conditioners For
`
`Automobiles, Order No. 6, Inv. No. 337-TA-334 (U.S.I.T.C. December 16, 1992) (finding good
`
`cause to give a limited number of party employees access to information produced under the
`
`protective order).
`
`In view of the foregoing, Complainants submit that there is good cause to amend the
`
`Protective Order in this Investigation, and respectfully request that this motion be granted.

`PROPOSED FIRST ADDENDUM TO ORDER NO. 1 REGARDING THE TESTING OF
`CONFIDENTIAL SAMPLES AND TREATMENT OF TEST RESULTS
`
`1. Each Party may designate up to three (3) of its employees (the “Testing Employees”) to
`be subject to the Protective Order (Order No. 1) for purposes of performing tests for
`certain PDC samples produced as CBI in this investigation (the “Confidential Samples”).
`Each party shall disclose the following:
`
`a. The name, educational history, and current title of each Testing Employee;
`
`b. A brief description of the job functions of each Testing Employee, including any
`past involvement in product research, development, and design;
`
`Each other party to the Investigation shall have three business days from the date of the
`disclosure to object to the designation of a Testing Employee. No Confidential Samples
`may be disclosed to a Testing Employee during this three-business day period unless all
`parties agree to waive the right to object to a Testing Employee.
`
`2. The Testing Employees shall not have access to any CBI produced in this Investigation
`except the Confidential Samples. Counsel for the producing party shall ship its samples to
`outside counsel in its standard packaging and, if available, shall provide a separate
`unmarked package (with the appropriate padding) to be used to transfer the samples to
`the Testing Employees with a coded designation. Counsel for the employing Party should
`take all reasonable steps to ensure that the Testing Employees do not have access to the
`identity of the Confidential Samples (including manufacturer, importer, or product
`designation);
`
`3. The Testing Employees may use any of their employing Party’s equipment to perform
`only the following tests on the Confidential Samples: Average Diamond Particle Grain
`Size, Specific Magnetic Saturation, Calculated Co wt%, Coercivity, G-Ratio, Thermal
`Stability, Electrical Conductivity, Specific Permeability, and analyzing for Lateral
`Dimension, a Substantially Planar Interface, and Grain Size Layering;
`

`4. The Testing Employees may perform preparation steps on the Confidential Samples
`reasonably related to the testing (e.g., cleaning, fixturing, polishing, sectioning,
`isolating);
`
`5. The Testing Employees may transmit results of any testing of the Confidential Samples
`to the Party’s (1) counsel for the employing Party or (2) any expert retained by the
`employing Party for this Investigation. The Testing Employee may not transmit or
`otherwise share the testing results or any design or technical details observed about any
`Confidential Sample during testing to any person not covered by the Protective Order.
`
`6. The Testing Employees shall promptly delete any copies or backups of the testing data
`from any of his/her Party’s equipment or computers following the transmission of the
`data pursuant to paragraph 5.
`
`7. Upon request by any party producing Confidential Samples, each Testing Employee shall
`provide an affidavit representing that the requirements of paragraphs 2, 3, 5, and 6 were
`complied with as to that party’s Confidential Samples.
`
`8. No Testing Employee shall be permitted to test any Confidential Samples that a
`producing party represents in writing were designated as CBI in this investigation on the
`basis (in whole or in part) that such samples reflect confidential research, development or
`commercial information of a third party, unless and until the producing party elects to
`identify the Testing Employee to such third party and such third party consents in writing
`to such testing. Absent such identification and consent, such samples shall be treated as
`CBI under the original Protective Order.
