`RESPONSES AND INITIAL EXPERT REPORTS OUT OF TIME

`On January 18, 2022, Complainant Arigna Technology Limited (“Arigna”) filed a motion
`
`(1267-027) for leave to amend its initial expert reports and contention interrogatory responses
`
`with information that Respondents Volkswagen AG and Volkswagen Group of America, Inc.
`
`(“Volkswagen”) produced after the close of fact discovery. Arigna represents that the motion is
`
`not opposed by any of the other Respondents or the Commission Investigative Staff.
`
`Fact discovery disclosed on December 15, 2021, and initial expert reports were due
`
`December 23, 2021. See Order No. 14 (Sept. 22, 2021). Pursuant to Order No. 28 (Jan. 14,
`
`2022), Volkswagen supplemented its interrogatory responses after the close of fact discovery to
`
`produce documents and information regarding certain Volkswagen products. Arigna now seeks
`
`leave to amend its initial expert reports and contention interrogatory responses to incorporate the
`
`information produced by Volkswagen. Arigna submits that granting the motion will not affect
`
`any other deadline in the Procedural Schedule.
`

`There being no opposition and for good cause shown, the motion (1267-027) is hereby
`
`GRANTED, and Arigna has leave to amend its contention interrogatory responses and initial
`
`expert reports to incorporate the information disclosed by Volkswagen.
`
