`LEAVE TO TAKE DEPOSITION OUTSIDE THE CLOSE OF
`FACT DISCOVERY

`On February 16, 2022, Complainants Masimo Corporation and Cercacor Laboratories,
`
`Inc. (collectively, “Masimo”) filed a motion (1276-022) for leave to take a deposition outside the
`
`close of fact discovery. Masimo represents that there is no opposition to the motion from
`
`Respondent Apple Inc. (“Apple”).
`
`Pursuant to the Procedural Schedule (Order No. 6), fact discovery closes on February 23,
`
`2022. Masimo submits that an Apple witness, Saahil Mehra, is not available for a deposition
`
`until February 24, 2022. Masimo thus seeks leave to take Dr. Mehra’s deposition one day after
`
`the close of fact discovery. Masimo submits that granting this leave will not impact any other
`
`deadlines in the Procedural Schedule and no party will be prejudiced.
`
`There being no opposition and for good cause shown, the motion (1276-022) is hereby
`
`GRANTED.
`
