`On April 26, 2022, an order issued directing Respondents La Modish Boutique, Star Bay
`
`Group, Inc., Huizhou Xinshunzu Shoes Co., Ltd., and Jinjiang Anao Footwear Co., Ltd.
`
`(collectively, the “Non-Participating Respondents”) to show cause why they should not be found
`
`in default and why judgment should not be rendered against them for failing to respond to the
`
`complaint and notice of investigation. Order 55. The order directed the Non-Participating
`
`Respondents to make any showing of good cause by no later than May 18, 2022. The Non-
`
`Participating Respondents did not respond to Order No. 55.
`

`Commission Rule 210.16(b)(1)(ii) provides that if “the respondent fails to make the
`
`necessary showing [of good cause], the administrative law judge shall issue an initial
`
`determination finding the respondent in default.” 19 C.F.R. § 210.16(b)(1)(ii) (emphasis added);
`
`see also 19 C.F.R. § 210.16(b)(2) (“A motion for a finding of default as a sanction for . . . failure
`
`to make or cooperate in discovery shall be granted by initial determination.”). Because the Non-
`
`Participating Respondents have not responded to the order to show cause, they necessarily have
`
`failed to make the requisite showing of good cause to avoid default under the applicable rules.

`It is my initial determination that Respondents La Modish Boutique, Star Bay Group, Inc.,
`
`Huizhou Xinshunzu Shoes Co., Ltd., and Jinjiang Anao Footwear Co., Ltd. are in default pursuant
`
`to 19 C.F.R. § 210.16. The Non-Participating Respondents have therefore waived their right to
`
`appear, be served with documents, and to contest the allegations at issue in the investigation. See
`
`19 C.F.R. § 210.16(b)(4), 210.17(h).
`
`Pursuant to 19 C.F.R. § 210.42(h), this initial determination shall become the determination
`
`of the Commission unless a party files a petition for review of the initial determination pursuant
`
`to 19 C.F.R. § 210.43(a), or the Commission, pursuant to 19 C.F.R. § 210.44, orders on its own
`
`motion a review of the initial determination or certain issues herein.
