`
`UNITED STATES INTERNATIONAL TRADE COMMISSION
`WASHINGTON, D.C.
`
`Before the Honorable Monica Bhattacharyya
`Administrative Law Judge
`
`
`
`
`
`In the Matter of:
`
`CERTAIN MOBILE ELECTRONIC DEVICES
`
`
`
`
`
`Investigation No. 337-TA-1312
`
`RESPONDENTS’ NOTICE OF WITHDRAWAL OF PARTIAL OPPOSITION TO
`COMPLAINANT’S CONTINGENT MOTION TO TERMINATE THIS
`INVESTIGATION [MOTION No. 1312-002], RENDERING MOTION UNOPPOSED
`
`Respondents Lenovo Group Ltd., Lenovo (United States) Inc., and Motorola Mobility,
`
`LLC file this notice of withdrawal of their partial opposition to Complainant Maxell, Ltd.’s
`
`Conditional Motion to Terminate Investigation in its Entirety, rendering that motion unopposed
`
`and ripe for decision. See Mot. No. 1312-002 (EDIS Doc. ID 775687). The condition precedent
`
`for the motion to terminate, institution of Inv. No. 337-TA-1324, also has been met.
`
`On July 18, 2022, Complainant filed a motion to terminate the present investigation “in
`
`its entirety based on withdrawal of the Complaint contingent on the Commission instituting an
`
`investigation based on the -3625 Complaint.” EDIS Doc. ID 775687 at 4. In response,
`
`Respondents stated that they “do not oppose termination of this Investigation, but oppose the
`
`conditions Maxell is trying to place on that termination.” Resps.’ Partial Opp. to Maxell’s Mot.
`
`To Terminate (EDIS Doc. ID 776154) at 1. The Commission instituted Investigation No. 337-
`
`TA-1324 based on the -3625 Complaint on August 16, 2022, as noted in Respondents’ Notice
`
`filed yesterday. Resps.’ Notice (EDIS Doc. ID 778193) at 1.

`

`Yesterday, Respondents and Complainant met-and-conferred regarding the pending
`
`motion to terminate. Complainant stated that it did not intend to withdraw its motion to
`
`terminate, but noted that Respondents had opposed the motion. Therefore, Respondents file this
`
`formal notice withdrawing their partial opposition to that motion.
