`Complainants JUUL Labs, Inc. and VMR Products LLC, and respondents NJOY, LLC,
`
`NJOY Holdings, Inc., Altria Group, Inc., Altria Group Distribution Company, and Altria Client
`
`Services LLC move for leave to conduct the depositions of Mr. Steven Christensen and Mr. Joseph
`
`O’Hara after the January 26, 2024, close of fact discovery. Motion Docket No. 1368-005 (EDIS
`
`Doc. ID 812387) at 1. The Commission Investigative Staff does not oppose. See id.
`
`The private parties state that: (1) Mr. Christensen was previously noticed for deposition,
`
`while Mr. O’Hara was previously subpoenaed; (2) Mr. Christensen and Mr. O’Hara are
`
`unavailable for depositions until after the close of fact discovery; (3) JLI stipulates that it will not,
`
`based upon the fact that these depositions will be taken after the close of fact discovery, seek to
`
`preclude NJOY from relying upon the deposition testimony of these witnesses or any exhibits
`
`testified to during such depositions; and (4) this will not extend fact discovery beyond the taking
`
`of these depositions and will not alter or impact any other deadline in Order No. 13. Id. at 1–2.
`
`The private parties state that they expect to conduct the deposition of Mr. Christensen in January
`
`2024, and the deposition of Mr. O’Hara in February or March 2024. See id.
`

`There being no opposition and for good cause shown, Motion No. 1368-005 is GRANTED.
`
`The parties are directed to meet and confer and establish a date certain for the deposition of Mr.
`
`O’Hara.
`
