`ORDER NO. 39:
`
`GRANTING JOINT MOTION TO TAKE EXPERT DEPOSITIONS
`OUT OF TIME
`
`(April 15, 2024)
`
`Complainant NJOY, LLC and Respondent JUUL Labs, Inc. jointly move for leave to
`
`conduct the depositions of NJOY’s expert witness Dr. Thomas Vander Veen on April 17, 2024,
`
`and JLI’s expert witness Mr. Vincent Thomas on April 19, 2024, after the close of expert
`
`discovery. Motion Docket No. 1372-032 (EDIS Doc. ID 818537). The Commission Investigative
`
`Staff does not oppose.
`
`Pursuant to Order No. 22, expert discovery closes on April 16, 2024. The movants state
`
`that, due to scheduling conflicts of the parties’ experts and prior commitments, and to avoid
`
`double-tracking expert depositions, deposition dates for Dr. Vander Veen and Mr. Thomas could
`
`not be scheduled during the expert discovery period. Mot. at 1.
`
`There being no opposition and for good cause shown, Motion No. 1372-032 is GRANTED.
`
`SO ORDERED.
