`I am contacting you to express my support for the issuance of a general exclusion in Inv.
`No. 337-TA-424. I believe the issuance of such an order is warranted as part of the effort to
`protect consumers and the public interest. I understand the Commission has deteimined that
`Kool and Lucky Strike Cigarettes produced for the export market are not the same as those
`produced for U. S. market, and I agree with those findings. I further believe that gray market
`cigarettes are frequently sold at gieatly reduced prices, which I fear could contribute to increased
`smoking among our Nation’s youth.
`
`In recent years, I have seen a dramatic rise in the level of gray market cigarettes sold in
`North Carolina. I believe that this increase is due in part to the fact that reimported cigarettes are
`not subject to the payment premium of the Master Settlement Agreement, which deprives North
`Carolina of an important source of revenue that could be used for public purposes. I am aware of
`federal and state legislative initiatives that are intended to stop the importation of gray market
`cigarettes. However, I believe the problem is so widespread and pervasive that these legislative
`initiatives are not sufficient alone. A general exclusion order against KO 01 and Lucky Strike will
`focus fbrther attention on this important issue and help ensure that, at the very least, gray market
`Kool and Lucky Strike Cigarettes are not imported.
