`ORDER NO. 63: ORDER DENYING COMPLAINANT SKF USA 1NC:”s
`MOTION TO COMPEL, AND DENYING
`BEARINGS DISTRIBUTORS INC.’S MOTION TO COMPEL
`
`I -
`
`4
`
`. .
`2J
`
`(November 12,2002)
`
`On October 25, 2002, COMPLAINANT, SKF USA Inc. (“SKF”) timely
`
`moved [469-0731 for an order compelling RESPONDENT, Bearings Distributors Inc.
`
`(“ED”) to fully respond to SKF’s Interrogatories and Requests for Documents Requests, and
`
`for a shortened response time to the motion. On October 28,2002, BD untimely and with
`
`out leave to file out of time, filed its own motion [469-881 to compel SKF to respond to
`
`BD’s Interrogatories and Document Production Requests. On November 7, 2002, SKF’s
`
`filed its opposition to BD’s motion noting its lack of timeliness, its inadequate justification
`
`for further discovery regarding Chicago Rawhide while noting SKF’s intention to
`
`supplement its responses to Interrogatories 6 1, 62, 8 1 and 82.
`
`Good cause not having been shown as to why BD filed its motion to compel
`
`late, the motion is therefore denied. However, SKF is directed to provide the supplements
`
`to Interrogatories 6 1,62, 8 1 and 82 that it had indicated its willingness and intention to do.
`
`

`
`With respect to SKF’s motion to compel, the undersigned directs that SKF and
`
`BD conduct immediate and serious “meet and confer” sessions to resolve the outstanding
`
`discovery requests. Further, having conducted such “meet and confer” sessions, if disputes
`
`remain unresolved, SKF is directed to file by the close of business on November 14,2002,
`
`a motion to compel that complies with the undersigned’s ground rules which means that for
`
`each dispute, movant shall list on separate page: #1 the enumeration of each, discovery item
`
`in dispute; #2 what the opposing party has provided in response and why it claims discovery
`
`should not be granted; #3 movant’s contention as to why discovery of the item ought to be
`
`granted. Beginning at 1O:OO am on November 18, 2002, until completed, the undersigned
`
`shall hear argument on each remaining discovery dispute.
`
`SO ORDERED.
