`W. Ron Robins files this Conditional Motion to Quash in part the hearing subpoena for
`
`the testimony of Mr. W. Ron Robins. The hearing subpoena, attached as Exhibit 1, requires
`
`attendance at the hearing on January 22, 2004 or at some other time ordered or agreed to by the
`
`parties.
`
`Mr. Robins is currently available to testify at the hearing on January 22 or January 23,
`
`2004. Mr. Robins is, however, unavailable to testify at the hearing after January 23, 2004. Mr.
`
`Robins is retired and is not actively involved in this case. Mr. Robins has pre-paid,
`
`nonrefundable airline tickets for a family vacation out of state beginning on January 24, 2004.
`
`Therefore, to the extent that the subpoena would require attendance at the hearing on any date
`
`after January 23, 2004, W. Ron Robins respectfully request that the Administrative Law Judge
`
`quash the subpoena.
