`On December 2, 2003, pursuant to 19 U.S.C. 9 1337(g)(l) and Commission rule
`
`210.16, complainant Superbag Corp. moved for an order directing that respondent Nantong
`
`Huasheng Plastic Products Co. (Nantong) show cause why it should not be found in default for
`
`failure to respond to the complaint and notice of investigation, as amended, pursuant to
`
`Commission rule 210.13, and upon failure to show cause to issue an initial determination finding
`
`said respondent in default with the immediate entry of a limited exclusion order, cease and desist
`
`order andor other appropriate relief against said respondent. (Motion Docket No. 492-8.)
`
`The staff supported the pending motion insofar as it was related to respondent Nantong.
`
`Respondent Nantong in Order No. 15 was ordered to show cause why it should not be
`
`found in default, pursuant to Commission rule 210.16, no later than the close of business on
`
`December 30,2003.
`
`Respondent Nantong did not respond to Order No. 15. In addition Nantong did not
`
`submit a pre-hearing statement pursuant to Order No. 9 and has not participated in the
`
`evidentiary hearing conducted on January 20 and 21 , 2004.
`

`Based on the foregoing, Nantong is found in default pursuant to Commission rule 210.16.
`
`While complainant in its Motion No. 492-8 requested “immediate entry” of a limited exclusion
`
`order, the administrative law judge, to avoid piecemeal recommendations, is holding the request
`
`in abeyance.
`
`Certain Plastic Molding Machines With Control Systems Having
`
`Programmable Operator Interfaces Incorporating General Purpose Computers, And Components
`
`Thereof 11, Inv. No. 337-TA-462, Comm’n Op. at 11 (April 2, 2003).
`
`This initial determination, pursuant to Commission rule 210.42(c), is hereby CERTIFIED
`
`to the Commission. Pursuant to Commission rule 210.42(h)(3), this initial determination shall
`
`become the determination of the Commission within thirty (30) days after the date of service
`
`hereof unless the Commission grants a petition for review of this initial determination pursuant
`
`to Commission rule 210.43, or orders on its own motion a review of the initial determination or
`
`certain issues therein pursuant to Commission rule 210.44.
