`This investigation was instituted on September 6,2006, and assigned to Judge Robert
`
`Barton. See Notice of Investigation, 71 Fed. Reg. 52577 (2006). Judge Barton set the target date
`
`for completion of this investigation as December 6,2007. See Order No. 2. Following Judge
`
`Barton's resignation, the Commission reassigned this investigation to the undersigned. See
`
`Commission Notice (July 5,2007). At the time of reassignment, this investigation was subject to
`
`a stay that was put in place by Judge Barton in anticipation of his departure. See Order No. 42.
`
`It is clear that as a result of the stay imposed by Judge Barton, the original target date
`
`must be modified. In response to Order No. 46, the undersigned has already received statements
`
`from the parties concerning their availability for an evidentiary hearing. In order to
`
`accommodate the schedules of the parties, and in view of several other investigations set for
`
`hearing before the presiding judge, by necessity the hearing will have to be scheduled for early
`
`2008. It is anticipated that within the next two weeks, the requirements of this investigation will
`
`be clarified and at least one investigation set for hearing in early 2008 may be terminated by
`
`
`
`agreement of the parties. At that time, a final procedural schedule and target date will issue in
`
`this investigation allowing for the scheduling of the hearing in this matter for the earliest time
`
`practicable.
