`TIME TO RESPOND TO MOTIONS FOR SUMMARY DETERMINATION

`Complainant Applica Consumer Products, Inc. (_"‘ACPI"') Jereby respectfully requests a
`
`brief two (2) day extension of time for all parties to respond to the motions For summary
`
`determination tiled on July 3, 2008. Specifically, ACPI requests that the parties’ responses to the
`
`multiple motions for summary determination be due on Friday, Ju y 18, 2008. The Commission
`
`Investigative Staff Attorney (the "'Staff‘) and Respondents support the requested extension of
`
`time and further request that.
`
`in the event the instant motion is granted, the same extension of
`
`time be given to the Staff and Respondents.
`
`On July 3, 2008, the last day to file motions for summary determination, Respondents
`
`collectively, or individually, filed ten (10) motions for summary determination relating to issues
`
`of infringement, validity and enforceability of U.S. Patent No. RE 36,84? (the “S47 Patent”).
`
`See Motion Docket Nos. 48-5?. However. due to the Fourth of July holiday, some of
`
`Respondents’ motions for summary determination and accompany _ng memoranda, statements of
`
`material fact and exhibits were not served on ACPI until four (4) days later, on Monday, July 7,
`
`2008. Respondents’ ten (10) motions for summary determination zotal several hundred pages of
`
`documents,
`
`including exhibits
`
`and declarations,
`
`and concern issues
`
`such as whether
`
`SSIE-19.1
`
`
`
`Respondents’ products infringe the ‘847 Patent, whether the ‘S47 Patent is valid in light of
`
`certain prior art, whether the ‘84? Patent meets the best mode requirement of 35 U.S.C. § 112,
`
`and whether the ‘84? Patent is enforceable. While ACPI will endeavor to file as many responses
`
`to the multiple summary determinations as possible on the current due date (r’.e.. Wednesday.
`
`July 16, 2008), due to the volume and complexity of the multiple motions for summary
`
`determination, as well as the logistics of filing these responses, AC PI believes that a brief two (2)
`
`day extension of time is appropriate. Accordingly, in order to ensure that ACPI is able to brief
`
`fully each issue so that the Administrative Law Judge can consider the multiple complex issues
`
`involved in this investigation, ACPI believes that good cause exists to grant its request for a brief
`
`two (2) day extension of time.
`
`Pursuant to Ground Rule 3(ii)_. ACPI has conferred with C0'.lI‘1S€l
`
`for Respondents and the
`
`Staff regarding their positions on the instant motion for extension. Respondents and the Staff do
`
`not oppose the instant motion and. in the event that the extension i.~. granted. Respondents and the
`
`Staff request a similar extension for their responsive briefs. ACPI ioes not oppose Respondents‘
`
`and the Staffs reciprocal request.

`to extend the deadline to respond to the motions for summary determination by two (2) days and
`
`requests that all such responses be due on or before July 18, 2008.
