`Siliconware Precision Industries Co., Ltd. and Siliconware USA Inc., (collectively,
`
`“Siliconware”) hereby oppose Tessera, Inc.’s (“Tessera”) motion to shorten time to respond to
`
`Tessera’s “Emergency” Motion To Compel Depositions and for Costs.
`
`While Tessera’s Motion seeks to shorten the time for Siliconware to respond, Tessera
`
`does not provide any basis for this request. Indeed, Tessera does not even indicate the relief it
`
`seeks. Since Tessera failed to meet and confer on this, Siliconvvare does not understand why
`
`Tessera believes that a shortened response time is necessary or even what Tessera is seeking.
`
`Siliconware would be prejudiced were the Court to shorten its time to respond to the
`
`Motion to compel. In its l2 page motion and 31 accompanying exhibits, Tessera makes
`
`significant and unfounded allegations and demands over $30,000 in alleged costs. Siliconware
`
`requires time to review and rebut these spurious claims. At the same time, Siliconware is
`
`responding to Tessera’s Motion to Amend the Complaint and Notice of Investigation (which
`
`Tessera has also designated as an “emergency” and sought to shorten the response time).
`

`
`In contrast, Tessera will not suffer any prejudice were Siliconware permitted ten days to
`
`respond as allowed for in Ground Rule 3.6. Fact discovery does not close until December 9,
`
`2008 and Siliconware has already proposed dates the week of November 10, 2008 for the
`
`depositions that Tessera seeks to compel.
`
`Thus, Tessera’s Motion to Shorten Time should be denied. Since Tessera did not file or
`
`serve the declaration in support of its Motion to Compel until October 8, 2008, Siliconvx/are’s
`
`opposition should be due Monday, October 20, 2008 as set forth in the Court’s Ground Rules.
