`On August 19, 2011, respondents AU Optronics Corporation and AU Optronics
`
`Corporation America (collectively “AUO”) filed a motion to exclude each of complainants
`
`Thomson Licensing SAS and Thomson Licensing, LLC’s (collectively “Thomson”) fact
`
`witnesses from the hearing and fiom reviewing any Witness statements before and during the
`
`hearing. (Motion Docket No. 749-021.)1 On August 31, 2011, Thomson filed a response
`
`opposing the motion.
`
`AUO claims that a dispute arose when Thomson sought to disclose the witness statement
`
`of Dr. Anthony Lowe, AUO’s expert, to Dr. Jackson Ho, a fact witness for Thomson. AUO
`
`opposes such a request, asserting that it would be improper for a fact witness to review the
`
`testimony of an expert witness prior to the hearing.
`
`As a matter of practice, I exclude fact witnesses from the hearing upon the request of a
`
`party, regardless of the positions of the other parties in the investigation. Because I utilize
`
`1 AUO’s motion is titled “Motion for Sequestration of Complainants’ Fact Witnesses.” This Order uses the term
`“exclusion” rather than “sequestration.”

`witness statements in lieu of live direct testimony, it follows that fact witnesses shall not read
`
`any witness statements from other witnesses prior to testifying at the hearing. Subject to
`
`confidentiality issues, fact witnesses may remain in the courtroom after they have completed all
`
`of their witness testimony.
`
`ORDER
`
`Motion No. 749-021 is hereby GRANTED. Fact witnesses shall not read any other
`
`witness statements in this investigation prior to completing their witness testimony at the
`
`hearing. All fact witnesses shall be excluded from the courtroom until they have completed their
`
`witness testimony.
`
