`RESPONDENT HIGHLINE UNITED LLC
`
`Please take notice that Highline United LLC (“Respondent Highline United”), named as a
`
`respondent in the Complaint filed in this Investigation, has been dissolved and no longer exists as
`
`a corporate entity as described below.
`
`At the time Converse filed the Complaint in this Investigation on October 14, 2014, the
`
`entity Highline United LLC named as a respondent in the Complaint was an active, operating
`
`business entity. In May 2016, shortly before the Final Determination issued, Respondent
`
`Highline United filed a voluntary petition for relief under Chapter ll of the Bankruptcy Code.
`
`See In re: Highline United LLC, Case No. 16-11659 (Bankr. D. Mass.), consolidated with In re:
`
`MSC Liquidation LLC, Case No. 16-11658 (Bankr. D. Mass.). In the course of the bankruptcy
`
`proceedings, Respondent Highline United became HU Liquidation, LLC. On September 28,
`
`2018, the U.S. Bankruptcy Court for the District of Massachusetts entered a Final Decree closing
`
`the bankmptcy proceedings. Upon the Bankruptcy Court’s entry of the Final Decree, the
`
`Debtors (including HU Liquidation, LLC, f/k/a Highline United LLC) were dissolved.
`
`Accordingly, HU Liquidation, LLC (f/k/a Highline United LLC —i.e., the Respondent Highline
`
`United LLC named in the Complaint) no longer exists.
`

`Termination of this Investigation as to Respondent Highline United is in the interest of
`
`the public and administrative economy, as removing this dissolved entity from the Investigation
`
`will conserve both public and private resources. In addition, there are no extraordinary
`
`circumstances that would preclude the termination of this Investigation as to the dissolved
`
`Highline United entity that was named a Respondent in the Complaint.
`
`In April 2016, a new Delaware limited liability company - also called Highline United
`
`LLC —was formed and now sells the imported goods that are the subject of this Investigation.
`
`The new Highline United LLC entity, incorporated in April 2016, is filing a separate Motion to
`
`Intervene in this Investigation as a Respondent.
`
