`Pursuant to Order No. 5 and Ground Rule 9.8.12, Complainant ParkerVision, Inc.
`
`(“ParkerVision”) respectfully submits this request for the receipt of evidence without a sponsoring
`
`witness. ParkerVision requests that certain exhibits on its exhibit lists be received into evidence
`
`without a sponsoring witness. A listing of the exhibits subject to this request is provided more fully
`
`below. These exhibits fall into the following categories:
`
`1. Discovery responses provided by the Respondents in this Investigation;
`
`2. Designated deposition transcripts of Respondents’ 30(b)(6) corporate representatives
`
`and marked exhibits;
`
`3. Designated deposition transcripts of employees at Qualcomm who are under the control
`
`of Qualcomm;
`
`4. Respondents’ responses to the complaint;
`
`5. Stipulations between ParkerVision and each Respondent related to importation and/or
`
`inventory; and
`
`6. The Asserted Patents and their respective prosecution histories and assignment records;

`COMPLAINANT PARKERVISION, INC.’S REQUEST FOR RECEIPT OF EVIDENCE WITHOUT A SPONSOR

`
`Commission Rule 210.37 provides that “[r]elevant, material, and reliable evidence shall be
`
`admitted” into the record. Ground Rule 9.8.12 requires that each exhibit offered into evidence have
`
`a “sponsoring witness.” However, the rule makes an exception for exhibits that are “non-
`
`controversial” and “appropriate for admission into evidence without a sponsoring witness.” Good
`
`cause exists to admit these exhibits into the record without sponsoring witnesses because they are
`
`relevant, material, reliable, and non-controversial. See Certain Network Devices, Related Software,
`
`& Components Thereof (II) (“Network Devices”), Inv. No. 337-TA-945, Order No. 41 (Oct. 29,
`
`2015); Certain Light-Emitting Diode Prods. & Components Thereof, Inv. No. 337-TA- 947, Order
`
`No. 34 (Oct. 8, 2015). Moreover, each of the exhibits in categories 1-4 contains statements of party
`
`opponents. ParkerVision makes this request in order to streamline the hearing without prejudicing
`
`Respondents or the Staff.
`
`Specifically, ParkerVision seeks to enter the following categories of exhibits without a
`
`sponsoring witness:
`
`I. DISCOVERY RESPONSES OF PARTY OPPONENTS
`
`ParkerVision seeks to enter Respondents’ responses to ParkerVision’s discovery requests
`
`into evidence without a sponsoring witness, consistent with the Commission Rules. ParkerVision
`
`will submit to the ALJ the proposed exhibits contained in Appendix A, which contain Respondents’
`
`complete responses to ParkerVision’s discovery requests. Each of the proposed exhibits is a true
`
`and accurate copy of Respondents’ discovery responses and has been prepared by or at the direction
`
`of counsel, as laid out in the attached declaration of Daniel B. Weinger. Respondents’ responses to
`
`interrogatories are standard, required submissions by a litigant in any Section 337 investigation and
`
`contain information relevant and material to all issues in this investigation, such as infringement,
`
`validity, remedy, and bond. These documents constitute party admissions, and bear the signature of
`

`Respondents’ counsel, demonstrating their authenticity. Moreover, pursuant to the Commission
`
`Rules, these discovery responses are admissible as evidence. See 19 C.F.R. § 210.29(a).

`Accordingly, Respondents’ discovery responses are reliable and non-controversial, and are
`
`appropriate for admission without a sponsoring witness.
`
`II. DESIGNATED DEPOSITION TRANSCRIPTS OF PARTY OPPONENTS’ 30(B)(6)
`CORPORATE REPRESENTATIVES AND MARKED EXHIBITS
`
`The designated portions of the deposition transcripts of Respondents’ 30(b)(6) corporate
`
`representatives contained in Appendix B, along with certain exhibits discussed in those excerpts are
`
`properly admissible without a sponsoring witness and good cause exists to admit these exhibits into
`
`evidence. Each of the proposed exhibits is a true and accurate copy of the final deposition
`
`transcripts of Respondents’ corporate witnesses with designated testimony highlighted and has been
`
`prepared by or at the direction of counsel, as laid out in the attached declaration of Daniel B.
`
`Weinger. The designated testimony is properly admissible against Respondents under Commission
`
`Rule 210.28(h)(2), which allows for the deposition of a party, such as Qualcomm, Apple, LG, and
`
`Samsung, be “used by an adverse party for any purpose.” The witnesses at these depositions gave
`
`their testimony under oath, and Respondents’ counsel was present at each of the depositions and the
`
`witnesses had the opportunity to review and correct any errors in the deposition transcripts. Thus,
`
`the designated transcripts and accompanying exhibits are material and reliable and should be
`
`admitted into evidence without a sponsor. The parties have already exchanged designations on July
`
`20, July 25, and July 27.

`III. DESIGNATED DEPOSITION TRANSCRIPTS OF EMPLOYEES AT QUALCOMM
`WHO ARE UNDER THE CONTROL OF QUALCOMM

`The designated portions of the deposition transcripts of certain Qualcomm engineering
`
`employees contained in Appendix C, along with certain exhibits discussed in those excerpts, are

`properly admissible without a sponsoring witness and good cause exists to admit these exhibits into

`evidence. Each of the proposed exhibits is a true and accurate copy of the final deposition

`Weinger. The designated testimony is properly admissible against Respondents under Commission
`
`Rule 210.28(h)(2), which allows for the deposition of a party, such as Qualcomm, be “used by an

`adverse party for any purpose.” The Qualcomm engineering employees are under the control of
`
`Qualcomm, as recognized by Ground Rule 4.6.3 (“Hearing subpoenas for witnesses within a
`
`party’s control, e.g. an employee, are generally not issued.”). As such, the depositions contain
`
`statements of a party opponent and are properly admissible against Respondents under Commission
`
`Rule 210.28(h)(2). The witnesses at these depositions gave their testimony under oath, and
`
`Qualcomm’s counsel was present at each of the depositions and the witnesses had the opportunity
`
`to review and correct any errors in the deposition transcripts. Thus, the designated transcripts and
`
`accompanying exhibits are material and reliable and should be admitted into evidence without a

`IV. RESPONDENTS’ RESPONSES TO THE COMPLAINT
`
`ParkerVision request that copies of Respondents’ Responses to the Complaint and exhibits
`
`thereto be received into evidence without a sponsoring witness. These documents are relevant,
`
`material, reliable, and non-controversial, and are therefore appropriate for receipt into evidence
`
`without a sponsoring witness. Respondents’ Responses to the Complaint and any exhibits attached
`
`thereto are standard, required submissions by a respondent in any Section 337 investigation, and are
`
`thus relevant and material. See 19 C.F.R. § 210.13(b). Further, the documents have already been
`
`verified, demonstrating their reliability and that they are non-controversial. Moreover, these

`STIPULATIONS BETWEEN PARKERVISION AND EACH RESPONDENT
`RELATED TO IMPORTATION AND/OR INVENTORY
`
`ParkerVision requests that copies of the importation and/or inventory stipulations between
`
`ParkerVision and each Respondent be received into evidence without a sponsoring witness. The
`
`inventory and importation stipulations listed below are the result of negotiations between
`
`ParkerVision and each Respondent related to importation and domestic inventory, and were entered
`
`into in order to avoid burdening parties with discovery into non-controversial issues of fact. These
`
`stipulations contain admissions by Respondents of importation and domestic inventory of the
`
`Accused Products, are relevant, material, reliable, and non-controversial, and are therefore
`
`appropriate for receipt into evidence without a sponsoring witness. The following exhibits fall into
`
`this category:

`VI. THE ASSERTED PATENTS AND THEIR RESPECTIVE ASSIGNMENT
`RECORDS
`
`The Asserted Patents and their prosecution histories should be received at the hearing
`
`without a sponsoring witness. These documents are non-controversial public records and are
`
`appropriate for receipt into evidence because they are relevant, material, and reliable. These
`
`documents are relevant, material, and of importance to all issues being litigated, including issues of
`
`infringement, invalidity, enforceability, and domestic industry. Proper foundation for the proposed
`
`exhibits is laid out in the attached declaration of Daniel B. Weinger. Permitting introduction of
`
`these documents without a sponsoring witness conserves time and resources at the hearing. Insofar
`
`as the authenticity of these documents is not in doubt given their origin, these documents are
`
`appropriate for receipt into evidence without a sponsoring witness. Further, the Asserted Patents
`
`and prosecution histories are already part of the Commission record pursuant to Commission Rule
`
`210.38(a). Accordingly, receiving these documents into evidence without a sponsoring witness is
`
`consistent with Commission Rules, non-prejudicial to any party, and necessary to create a more
`
`complete record in this investigation. Due to their length, a list of the exhibits that fall into this
`
`category is attached as Appendix D.
`
`VII. CONCLUSION
`
`For the reasons stated above, ParkerVision respectfully requests that the exhibits described
`
`and identified above be admitted into evidence without a sponsoring witness.
