`POINTS AND AUTHORITIES
`Client retained Former Counsel, to represent Client in the above-entitled action. A written
`retainer agreement was executed by Client. (See Exhibit 1 attached hereto). During the period of
`time in which Counsel represented Client, fees may have been incurred and/or costs were possibly
`advanced, which are still outstanding pursuant to the terms of said retainer agreement.
`On or about, October 1, 2020 Current Counsel was retained by Client in the above-entitled
`action. Former Counsel was terminated by the Former client simultaneously and the lien was
`specifically acknowledged by the undersigned. (See Exhibit 2 attached hereto).
`A Notice of Claim of Lien has been filed by Former Counsel. (See Exhibit 3 attached
`hereto). A file-stamped copy of said Notice together with this Motion will be served upon all
`interested parties, including Former Counsel.
`NRS 18.015 states, in part, as follows:
`1. An attorney at law shall have a lien:
`(a) . . .
`(b) In any civil action, upon any file or other property properly left in the
`possession of the attorney by a client.
`
`2. A lien pursuant to subsection 1 is for the amount of any fee which has been
`agreed upon by the attorney and client. In the absence of an agreement, the lien is
`for a reasonable fee for the services which the attorney has rendered for the client.
`
`3. An attorney perfects a lien described in subsection 1 by serving notice in writing,
`in person or by certified mail, return receipt requested, upon his or her client and, if
`applicable, upon the party against whom the client has a cause of action, claiming
`the lien and stating the amount of the lien.
`
`4. A lien pursuant to:

`(b) Paragraph (b) of subsection 1 attaches to any file or other property
`properly left in the possession of the attorney by his or her client, including,
`without limitation, copies of the attorney's file if the original documents
`received from the client have been returned to the client, and authorizes the
`attorney to retain any such file or property until such time as an adjudication
`is made pursuant to subsection 6, from the time of service of the notices
`requested by this section.
`
`5. A lien pursuant to paragraph (b) of subsection 1 must not be construed as
`inconsistent with the attorney's professional responsibilities to the client.
`
`6. On motion filed by an attorney having a lien under this section, the attorney's
`client or any party who has been served with notice of the lien, the court shall, after
`5 days' notice to all interested parties, adjudicate the rights of the attorney, client or
`other parties and enforce the lien.
`
`7. Collection of attorney's fees by a lien under this section may be utilized with,
`after or independently of any other method of collection.
`
`Section 2. The amendatory provisions of this act apply to any fee for the services of any
`attorney incurred by a client for services rendered before, on or after July 1, 2013.
`Section 3. This act becomes effective on July 1, 2013.
`
`In the State of Nevada it is clear that an attorney's right to compensation is not based upon
`or limited to his lien; such right is based upon an express or implied contract and the lien is but
`security for the attorney's right. Gordon v. Stewart, 74 Nev. 115, 324, P.2d 234, 235 (1958).

`COMES NOW, TRAVIS E. SHETLER, ESQ., and says;
`That Declarant is an attorney duly licensed to practice law in the State of Nevada
`(hereinafter, "Current Counsel") and currently represents TAMARA VASEY, individually and as
`Special Administrator of the Estate of DELAND SIDNEY VASEY, Deceased, (hereinafter,

`MEMORANDUM OF POINTS & AUTHORITIES

`FACTUAL BACKGROUND
`
`The underlying facts of this case involve a heavily medicated FedEx driver causing a
`
`catastrophic and deadly crash while operating a FedEx 18-wheeler on the freeway outside of Tonopah,
`
`Nevada. Tamara Vasey is the surviving spouse of the decedent driver who died as a result of the
`
`FedEx driver’s negligence. This is a multi-million dollar case, recently settled for an undisclosed
`
`amount at a mediation.
`
`Attorney Shetler was an attorney at Burris and Thomas (f,k.a. Law Offices of Steven Burris)
`
`where he and other lawyers worked on the Vasey case when it came in. For reasons unrelated to this
`
`case, Mr. Shetler was later terminated from the firm, and he then persuaded various clients to fire the
`
`Burris firm, and come to his newly formed solo practice (Ms. Vasey among them.) As such, Burris
`
`& Thomas properly, and pursuant to NRS 18.015, placed an attorney’s lien on the file. The Vasey
`
`case had been the Burris’ firm best case, and considerable time and resources had been invested in the
`
`case at the time Shetler took it.
`
`The work Burris & Thomas performed on behalf of the estate, is in large part the same work
`
`that went into establishing Tamara Vasey’s individual claims in her case. As such, is it difficult, if not
`
`impossible, to “apportion” the attorneys’ fees between the case for the estate of her husband, and her
`

`individual claims as, for example, one email and one motion were almost always related to both cases.
`
`Instead of “double-dipping”, Burris & Thomas provided a legitimate spreadsheet detailing its time
`
`spent and rates charged without “double dipping” on the same email, interoffice communication, etc.
`
`twice for the two different matters. Burris & Thomas has provided a good faith accounting of its time
`
`and monies spent.
`
`Burris & Thomas now seeks a “global” or “joint and several” lien, under which Ms.
`
`Vasey and Mr. Shetler would be required to reimburse Burris & Thomas for the total
`
`adjudicated lien amount + costs from either, or both cases combined. Burris & Thomas requests
`
`the situation be handled in this manner so that Burris & Thomas is not unfairly prejudiced by Shetler
`
`arranging for the settlement amounts for each claimant (Estate and Tammie Vasey) to be strategically
`
`apportioned to avoi
