`STATEMENT OF FACTS
`Respondents have calculated petitioner’s good time and work time da
`ys of credit/deduction
`based on their own analysis and/or methodology rather than according to clearly established law under
`NRS 209.4465
`Thus, petitioner (will be/has been) subject to excessive confinement, and/or a longer term of
`imprisonmentthan the court intended, as a result ofthe NDOC policy or procedure.
`Furthermore, the NDOC denies work time days or deductions to those inmates who do not
`participate in a work or educational assignment. This policy would be fair and just provided that the
`NDOChad the jobs oreducational programs that would allow all inmates the equal opportunity to earn
`ten (10) days per month deduction from their sentences, particularly when the inmate has not
`misbehaved orhasbeen subjectto disciplinary sanctions. Petitionerhas made every effortto participate
`in rehabilitation, educational, and/orwork programs while in prison.

`LEGAL ARGUMENT
`The rule is cardinal and universal that if a law is plainly unambiguous, there is no room for
`construction or interpretation, Brown v. Dayis, 1 Nev. 409, 413 (1865). NRS 209.4465 subsection 1
`providesin relevantpart that:
`|
`An offender sentenced to prisonfor a crime committed on or after July 17, 1997, who has no
`serious infraction of the regulations of the department,
`the terms and conditions of his residential
`confinement, or the lawsofthe state recordedagainst him, andwhoperforms in afaithful, orderly and
`peaceable manner the duties assigned to him, must he allowed
`“\...for the periodhe ts actually -
`incarceratedpursuant to his sentence [j.. 4 deduction oftwenty (20) days from his sentence each
`month he serves.”

`Subsection 2 ofNRS 209.4465 further provides for an additional ten (10) days deduction by the
`NDOC Director for diligent work or study. However, the Nevada Department of Corrections has
`improperly interpreted and applied the controlling statute as set fort above herein.
`The schema of the NDOC employed in the computation of the twenty (20) days per month,
`c=, commonlyreferredto as statutory goodtime, is permissibleinthatunlike therelatedprovision ofNRS
` 209.4465, subsection 2, the Director does not have any discretion in regard to the deduction under
`subsection 1. Therefore, the prison officials are making their calculations in a manner that denies
`petitioner his statutory right to libertywithout due process oflaw, whichis a constitutional violation.
`In the case at bar, the legislature itselfcreated a statutory right in NRS 209.4465, which defined
`therein the correct manner/formula for computing good and work time deductions; thereby, the State of
`Nevada created a liberty interest, requiring due process to ensure that such liberty is not arbitrarily

`Offenders are sentenced by the court to a prescribed time frame. The sentence prescribedis
`
`x documented in theJOC receivedwiththeoffenderbythe Nevada Department ofCorrections

`(NDOC).

`The JOC sets forth the prison sentence, or the MAX days owed by the offender. The MAX days
`owedare entered into the computer system as written by the court. The offenders’ credits are
`then projected with all the FLAT, STAT and . ~~ © days until the days remaining counts
`down to zero (0).
`
`The example below shows whenanoffenderis expected to be releasedif only FLAT credits
`were applied. With only the FLAT credits applied, the Parole Eligibility Date (PED) would be
`January 1°, 2021, and the Projected Expiration Date (PEXD) would be December 31° 2022.
`
`Per NRS chapter 209, the felony category, offense type, and sentence structure will determine
`how credits are distributed to the MIN and MAX,as applicable. For the example below,the
`guide is based on a non-violent category C felony.

`Finally, the cardinal rule ofstatutory construction is for a court to give effect to the legislature’s
`intent.
`“Whata legislature says in the text ofa statute is considered the best evidenceofthe |egislative
`intent or will,” andtherefore, the court must apply the plain meaning ofa statute whereits language is
`unambiguous and conveys 2 clear meaning.
`The court must reject a statute’s interpretation (the NDOC Merits Credits System Formula)
`leading to absurdanddisparate results not intended bythe legislature, issue an ORDERthat the Nevada .
`Department of Corrections halt its methodology or whatever formula they are applying to extend
`petitioner's sentence, and to apply provisions ofthe Nevada Revised Statue 209.4465 so that its full
`force andeffects benefit this petitioner.
