`The jury trial lasted ten (10) days, beginning on June 26,2023, and ending on July 11,
`2023. on July I 1, 2023, the jury found Defendant not guilty of count 4 and guilry of counts
`6-11. The jury hung on counts l, 2, 3, and 5. Accordingly, the District court declared a
`mistrial as to counts 1-3, and 5. The state chose not to retry Defendant on l-3 and 5.
`On August 22, 2023, the District Court imposed an aggregate sentence of LIFE with
`minimum parole eligibility after serving one-hundred-five (105) years in the Nevada
`Department of Corrections.
`
`On August 24, 2023, a ltdgment of Conviction was filed in this matter.
`
`On September 18,2023, Defendant filed a Notice of Appeal.
`
`On March 21,2024, Appellant's Opening Brief was filed with the Nevada Supreme
`Court. On May 22, 2024, Respondent's Answering Brief was frled. On June 20, 2024,
`Appellant's Reply Brief was fited.
`
`On October 10,2024, the Nevada Supreme Court filed an Order to Submit on Briefs.
`On November 14, 2024, the Court Filed an Order Affirming the Judgment of
`Conviction.
`
`On December 5,2024, the Court Issued a Remittitur, and the case was closed.
`
`On February 25,2025, Defendant filed a Motion for New Trial.

`I. DEFENDANT TS PROCEDURALLY BARRED FROM FILING A MOTION

`NRS 176.515 delineates that the Court may grant new trial or vacate judgment in certain
`
`circumstances and states:
`

`3. Except as otherwise provided in NRS 176.09187, a motion for a
`new trial based on the sround of newlv discovered evidence mav be
`made only within 2 yeais afler the verdict or finding of guilt.
`
`4. A motion for a new trial based on anv other srounds must be made
`within 7 days after the verdict or findin[ of guilior within such further
`time as thetourt may fix during the 7-Eay ieriod.
`Here, Defendant basis for filing a motion for new trial relies on numerous allegations
`
`asserting that his sentence is illegal, demanding that he be provided all ofthe discovery in this
`
`case to include all DNA genetic marker analysis within the control of the State pursuant to
`NRS 176.0918, alleging that he was unfairly convicted by an all-white jury and claiming a
`Batson issue, alleging that the district court erred in not granting a pretrial motion to change
`
`venue, alleging that he is entitled to all "disculpatory (sic) evidence" and claiming ineffective
`
`and/or conflict free counsel. None of the allegations made by Defendant in his motion are
`
`based on the grounds of newly discovered evidence.
`
`NRS 176.515(4) is clear that a motion for new trial based on any other grounds must
`
`be made within 7 days after the verdict or finding of guilt or within such further time the court
`may fix within the 7-day period. Here, Defendant was found guilty by jury verdict on July I 1,
`2023, and his instant motion has been filed well beyond the required 7-day time period
`
`delineated inNRS 176.515(4). As such, Defendant's is procedurally baned from requesting a
`
`new hial in this matter.r
`
`I Should Defgndant wish to raise Ineffective Assistance of Counscl (IAC) claims he must file a properly formarted habeas petttion
`pursuant to NRS 34.720, and should Defendant wish to file a genetic marker petition by person convicted of a felony, he must file a
`separate petition specific to the requirements delineated in NRS 176.0918, as each type of petition has specific procedural requirements
`that must be followed.

`Appointment of counsel in 9 2254 cases is authorized within 18 U.S.C.
`0 3006A(S) and 28 U.S.C. $0 1915(e)(l); 225a(h). This Court may appoint
`counsel vhere the "interests of justiee', so reguire. Jeffers v. Lewis, 68 F.3d
`295, 297 -98 (gth Cir. 1995). This interest is best served when indigent
`petitioners who are unable to "adequately present their cases,' are appointed
`counsel, to do so for them. It.
`Although appointment is usually within this Court's sound discretion, a
`handy formula for this Court's consideration is a balancing of the complexities
`of the issues with a consideration of the severity of the petitioner's penalty.
`Chaney v. Lewis, 801 F.2d 1191, 1196 (gth Cir.), cert. denied, 481 U.S. 1023
`(1987). Ultimately, however, ab€€nt
`a.dua process .j-EP.li-caLiqn,,. this Court has
`discretion to appoint counser when it feels that it promotes justice in doing
