`Plaintiffs La Jolla Pharmaceutical Company, La Jolla Pharma, LLC, and The George
`Washington University (collectively, “Plaintiffs”) and Defendants Gland Pharma Limited
`(“Gland”), Shanghai Fosun Pharmaceutical (Group) Co., Ltd. (“Fosun Shanghai”) and Fosun
`Pharma USA Inc. (“Fosun USA”) (collectively, “Defendants”) hereby stipulate as follows:
`
`1. The Complaint (ECF No. 1) against Fosun Shanghai and Fosun USA shall be
`dismissed without prejudice pursuant to Fed. R. Civ. P. 41(a)(1)(A) (i) and (i1).
`
`2. This action will continue against Gland.
`
`3. Nothing in this stipulation shall in any way limit Plaintiffs’ right to move to
`amend the pleadings on or before the deadline set by the Court. Likewise, nothing in this
`stipulation shall constitute a waiver by Gland, Fosun Shanghai, or Fosun USA of any objection
`
`or defense to any motion to amend the pleadings.

`4. Nothing in this stipulation shall constitute a waiver of any discovery available to
`
`Plaintiffs under the Federal Rules of Civil Procedure, the Federal Rules of Evidence, or any other
`
`applicable authority, including without limitation, discovery relating to Gland’s marketing
`
`partner(s) for Gland’s ANDA. Likewise, nothing in this stipulation shall constitute a waiver by
`
`Gland of any objection or defense to, or any privilege or immunity from, any discovery sought
`
`by Plaintiffs.
`
`5. The case caption should be amended to read: “La Jolla Pharmaceutical Company,
`
`La Jolla Pharma, LLC, and The George Washington University v. Gland Pharma Limited, Civil
`
`Action No. 2:22-cv-01754 (JXN)(JBC)”.
`
`6. Each party shall bear its own fees, expenses, and costs.
