`Norbitz, and all the exhibits thereto, and all prior pleadings and proceedings had herein,

`Plaintiffs/Counterclaim Defendants Syntel Sterling Best Shores Mauritius Limited, and Syntel, Inc.
`
`(“Syntel”) will move this Court, before the Honorable Steward D. Aaron, United States Magistrate
`
`Judge, at the United States Courthouse, Courtroom 11C, 500 Pearl Street, New York, New York 10007,
`
`at a time to be determined by the Court, pursuant to Rule 56 of the Federal Rules of Civil Procedure,
`
`

`for an Order (1) granting partial summary judgment in favor of Syntel in connection with the portion
`
`of Count I of its Amended Complaint (ECF No. 39) that pertains to the breach of MSA Section 23.02
`
`regarding transition rebates; (2) dismissing that portion of Count VII of the Defendants’ First Amended
`
`Counterclaims (ECF No. 215) pertaining to the alleged copyright infringement of Defendant The
`
`TriZetto Group, Inc.’s Data Dictionary and the alleged copyright infringement of any unregistered
`
`works; and (3) awarding Syntel any such other and further relief as the Court may deem just and proper.
`

`
`PLEASE TAKE FURTHER NOTICE that pursuant to the schedule set by the Court (ECF Nos.
`
`513, 514), answering papers, if any, shall be served and filed no later than July 31, 2019, and reply
`
`papers, if any, shall be served and filed no later than August 21, 2019.
