`STIPULATION AND ORDER OF TRANSFER OF VENUE AND DISMISSAL OF

`DEFENDANT SONY CORPORATION OF AMERICA
`
`WHEREAS on February 12, 2021, Plaintiff Lmarc Turner initiated this action
`
`against Defendants Sony Corporation of America and Sony Interactive Entertainment
`
`LLC (the “Defendants”) by filing a Complaint with this Court (Dkt. 1);
`
`WHEREAS, Plaintiff served Defendants with the Summons and Complaint on or
`
`around February 17, 2021;
`
`WHEREAS, the Court permitted Plaintifi to file an amended canphint by April
`
`5, 2021 and adjourned Defendants’ time to answer or respond to the amended complaint
`
`to May 7, 2021 (Dkt. 15);
`
`WHEREAS, Plaintiff alleges that he “agreed to the terms and conditions”
`
`other
`
`than the arbitratim provision~of the “PlayStation Terms of Service and User
`
`Agreement” (Compl.
`
`11 22), which includes a forum selection clause requiring that
`
`lawsuits be brought in the Northern District of California or in the Superior Courts for the
`
`State of California;
`
`WHEREAS, the Northern District of Califom‘n would have personal jurisdiction
`
`over Defendant Sony Interactive Entertainment LLC;
`

`WHEREAS, Plaintiff consents to dismiss Defendant Sony Corporation of
`
`America from this action without prejudice;
`
`WHEREAS, the parties have met and conferred and agreed that a transfer of this
`
`action to the Northern District of California is appropriate;
`
`NOW THEREFORE, IT IS HEREBY STIPULATED AND AGREED, subject to
`
`the Court’s approval, that:
`
`1. Defendant Sony Corporation of America is dismissed from this action
`without prejudice;
`
`2. This action is hereby transferred to the Nonhem District of California
`pursuant to 28 U.S.C. §1404; and
`
`3. Upon completion of such transfer, Plaintiff shall have 30 days in which to
`amend the Complaint and Defendant Sony Interactive Entertainment,
`
`LLC shall answer or otherwise respond within 45 days of service of the
`amended complaint.
