`Upon the fbregoing documents, the motion by Defendants to change the venue of this
`matter to Suffolk County pursuant to CPLR 5 l0 and 5 1 I is decided as follows:
`Plaintiff seeks recovery for injuries allegedly sustained as a result of a motor vehicle
`collision that occurred on May 12, 2022 in Suffolk County, New York.
`Plaintiff properly designated venue in New York County in accordance with the well-
`
`established rule that a foreign corporation's designation ofthe location of its office in its statement
`
`filed with the Secretary ofState constitutes a designation of its residence for venue purposes under
`CPLR 503 (c) (Nadle v L.O. Realty Corp.,286 AD2d 130 [l st Dept 2001]). Defendant Distribution
`International Southwest, Inc.'s designation of its office location as New York County in its
`statement filed with the New York Secretary of State was a designation of its residence for venue
`purposes under CPLR 503 (c) (see Johanson v J.B. Hunt Transp., Inc.,l5 AD3d 268 [st Dept
`2005] [Foreign corporation's designation of its office location in its statement filed with the New
`York Secretary of State was a designation of its residence lbr venue purposesl).
`
`Defendants' contention that venue should be changed for the convenience ofthe material
`
`witnesses is unavailing. The proponent ofa motion to transfer venue pursuant to CPLR 510 (3),
`
`the convenience of material witnesses, must set forth: (1) the identity of the proposed witnesses,
`

`(2) the manner in which they will be inconvenienced by a trial in the county in which the action
`has been commenced, (3) that the witnesses have been contacted and are available and willing to
`testi$ for the movant, (4) the nature of the anticipated testimony, and (5) the manner in which the
`anticipated testimony is material to the issues raised in the case (R odriguez-Lebron v Sunoco, Inc. ,
`l8 AD3d 275,275 [st Dept 2005);Cordonav Aggressive Heating, \nc.,180 AD2d572 [lstDept
`1992]). Defendants' submission does not establish that a change ofvenue from New York County
`to Suffolk County will promote the convenience of material witnesses or the ends ofjustice and
`as such Defendants have failed to meet this burden. The Court does not find that this action should
`be heard in another forum (Supreme Court, Suffolk County) in the interests of substantial justice
`and therefore, the court declines to exercise its discretion to stay or dismiss this action based upon
`the doctrine of forum non conveniens. Accordingly, it is
`ORDERED that Defendants' motion to change venue is denied in its entirety; and it is
`
`further
`
`ORDERED that the Clerk of the Court shalt schedule a preliminary conference at which
`all counsel shall appear; and it is further
`
`ORDERED that within 30 days of entry, Plaintiff shall serve a copy of this Decision and
`Order upon all parties with Notice of Entry.
`
