`Cattan, et al. v. Vasella, et al.
`Index No. 650463/2021 (Sup. Ct., N.Y. Cnty.)
`
`
`October 29, 2021
`
`
`Cravath, Swaine & Moore LLP represents the Novartis defendants in the
`above-captioned action.1 We write to respectfully request the Court’s approval of the
`attached stipulation regarding Defendants’ upcoming motion to dismiss. Plaintiffs
`respectfully join in this request as well.
`
`This stipulation is nearly identical to a stipulation that the parties
`submitted on September 1, 2021 (NYSECF No. 4) regarding service and motion to
`dismiss briefing and a stipulation submitted on October 15, 2021 (NYSCEF No. 9)
`regarding an extension of page limits. However, this stipulation adjusts the briefing
`schedule on the motion to dismiss so that the initial deadline is triggered by the Court’s
`order on the stipulation—allowing Defendants three days to file the motion to dismiss
`after the Court’s order on the stipulation.
`
`The Court’s decision on this stipulation will ensure that the parties may
`proceed with the motion to dismiss as described and that the parties are in compliance
`
`
`1 Specifically, Cravath represents Daniel L. Vasella, Joerg Reinhardt, Joseph Jimenez, Enrico C.
`Vanni, Srikant M. Datar, Ann M. Fudge, Andreas von Planta, Charles L. Sawyers, William T. Winters, Ton
`Buechner, Nancy C. Andrews, Kevin J. Buehler, Elizabeth Doherty, Frans van Houten, Patrice Bula, Simon
`E. Moroney, Bridgette P. Heller, Dimitri Azar, Felix R. Ehrat, Harry W. Kirsch, Vasant Narasimhan,
`Richard Francis, Rolf M. Zinkernagel, William R. Brody, Sir Jonathan R. Symonds, Jeffrey P. George,
`David R. Epstein, Thomas Werlen, Helmut Sihler, William W. George, Shannon Thyme Klinger, Novartis
`AG (as nominal defendant), Novartis Pharmaceuticals Corporation, Sandoz Inc. and Novartis Capital
`Corporation.
`
`
`
`
`

`

`
`with the relevant deadlines and page limits for the briefs. We are available to discuss the
`parties’ requests should the Court wish to do so.
`
`2
`
`Respectfully,
`
`/s/ Evan R. Chesler
