`defendants, JASON BRUCE and KEMAR PATRICK herein, and as such,I am fully familiar

`with the facts, circumstances and pleadings in the above action.

`CO. OF ARIZONA (hereinafter “UHAUL”) for an Order pursuant to CPLR 2201, granting a

`stay of the within iitigation pending the resolution of the dectaratory judgment action
`
`entitled, Repwest Insurance Company, formeriy known as Repubiican Western Insurance
`
`Company, U—Haul Co. of Arizona and U-l—iaul Co. of New York and Vermont, Inc. M.

` Rolanda Alston et ai., venued in the Supreme Court, Kings County, hearing Index No:

`2010 at approximately 7:50 pm. on 232'1d Street at its intersection with Francis Lewis
`
`Boulevard, Queens County, New York. A copy of the police report of this incident is
`
`annexed as Exhibit A.
`
`Copies of the plaintiff’s. summons and complaint and the
`
`pleadings thereto are annexed hereto as Exhibit B.
`

`This accident occurred, when the U-i—laui truck that was operated by the t2o=
`
`defendant, TTESi-EA SINCLAIR,
`
`rear—ended the motor vehicle that was owned by the
`
`defendant, JASON BRUCE, and operated by the defendant, KEMAR PATRICK. At the time
`
`of the subject accident, the plaintiff was a passenger in the motor vehicle operated by the
`
`defendant,
`
`KEMAR PATRICK. The
`
`rear—ending
`
`incident
`
`occurred while
`
`the
`
`BRUCE/PATRICK vehicle was at a full and complete stop at a stop sign on 232nd Street,
`
`and waiting for traffic on Francis Lewis Bouievard to clear before entering the roadway.
`

`The defendants in this matter,
`
`JASON BRUCE and KEMAR PATRICK,
`
`previously moved for summary judgment on the issue of liability in the corresponding
`
`action arising out of the same accident. The Honorable Dennis J. Butler of Supreme Court,
`
`Queens County,
`
`issued an Order, dated February 13,. 2013, which granted the
`
`defendants, JASON BRUCE and KEMAR PATRICK, summary judgment on the issue of
`
`iiability in the corresponding action of-Kenny Sinclair v. Jason Brace, et at, Supreme
`
`Court, Queens County, Index Number 700051/2011. A copy of that entered order is
`
`annexed hereto and made a part hereof as Exhibit C
`

`in the instant action your affirmant, on behalf of defendants, BRUCE and
`
`PATRECK, again moved motion for summary judgment on the issue of iiabiiity on the
`
`same grounds. Said motion was originally returnable in the Staten Court, mean
`

`County, before Justice Valerie Brathwaite Neison, on June 25, 2013.
`

`
`On June 26, 2013, one day after the original return date on your affirman‘t’s
`
`motion for summary judgment, the Summons and Complaint in the deciaratenr judgment
`
`action was filed in the Supreme Court, Kings County. Now, fer the first time, ceunsei fer
`
`UHAUL is seeking to stay the instant action so that a separate newiy camrnenceci action
`
`may be pursued, A copy of the elaw printout for the deciaratory action is annexed hereto
`
`as Exhibit D.
`

`In support of their argument, UHAUL, proffered aiieged confessions 0f Aiicia
`Burton, Sean Norman, and Tyrell Feider, which are not in admissible form, as they are not
`
`‘
`
`signed, notarized or given under oath with the penalty of perjury, As such, the only
`
`portion of UHAUL’s moving papers citing to the staged loss is embodied in the attached
`
`Summons and Complaint. An attorney affidavit without supporting proof in admissible
`
`form affords no probative value. See Zuckerman v. City of New York, 4-9 N.Y.2cl557, 553,
`
`427 N.Y.S.2d 595 (1980).
`

`The issuance of a stay is discretionary with the Court, and shall be exercised
`
`sparingly and “only when other remedies are inadequate and the equities involved are
`
`apparent and strong." In re Weinbaum's Estate, 51 Misc.2d'538, 273 hi.‘r’.S.2d 4-61, 463
`
`(MY. 1966).. As such, UHAUL’S Cross—Motion for a stay may be denied as the Ceurt deems
`
`appropriate.
`

`pursue an action against dozens of defendants,

`Such a delay is inappropriate to a party that has already filed a motion tot summary

`judgment on the basis of a prior Order issued regarding the same accident“

`Defendant U—HAUL CO- OF ARIZONA was negligent in that it allowed its

`vehicle to be operated in a negligent, reckless, and careless manner in
`
`violation of the law. This action falls within one or more of the exceptions set
`
`forth in CPLR 1601.

`That on or about July 22, 2010 at or about 7:50 p.m., Defendant KEMAR

`PATRICK. Was operating the 1999 Toyota automobile on Francis Lewis
`
`Boulevard near the intersection of 232nd Street in the county of Queens, State

`That on or about said time and place, said Defendant JASON BRUCE’S

`the Defendants.

`That the Defendant KEMAR PATRICK was negligent in that'he Operated said '

`motor vehicle in a negligent, reckless, and careless manner in Violation of the

`law, statutes? and ordinaneea and were otherwise negligent. Defendant

`JASON BRUCE was negligent in that lie-allowed his vettieie to be operated in

`pain and mental anguish, became sick, sore, lame, and disabled and so
`
`remained. As a result of the aforementioned injuries, the Plaintiff quality of
`
`life has suffered and will continue to suffer iIteparahle harm.

`As a result of the foregoing, the Plaintiff JEROME DAVIS has sustained a
`
`“serious injury" as defined by Section 5102(d) of the immense Law of the
`
`State of New Yorks and / or economic: loss greater than the basic economic
`
`loss as defined in Section 5102(a) of the insurance Law of the State of New
`
`Yorlt.
`
`AS a result of the foregoing, the Plaintiff JEROME DAVIS has been damaged

`Pursuant to an Order of this Court, dated January 23, 2013,
`this motion, originally Submitted before Centralized Motion Part
`on.January 17, 2013 was set down.for and oral argument was
`conducted oanebruary 5, 2013,
`
`in this action to-recover for personal injuries allegedly
`sustained in a motor vehicle accident on July 22, 2010,
`defendants Bruce and Kemar move for summary judgment Solely on
`
`
`
`the issue of liability. Defendant operator, Kemar, alleged in his
`deposition testimony,
`taken on August 2, 2012 (Ex. E)
`that he was
`.Stopped at a stop sign for “almost a minute and a half” when his
`vehicle was struck in the rear by the truck owned by COv
`'
`defendant,
`fl-Haul Co. Of Arizona (“UFHaul"}, and operated by co—
`defendant, Tiesha Sinclair (“Sinclair”}{p, 11,
`i2). As such,
`defendants Bruce and Kemar have established a prima facie case of
`negligence against co—defendants, Uuflaul and Sinclair, a lack oi
`negligence against moving defendants, and entitlement to summary
`
`judgment {eee, Castle v. Bawuah, 101 AJD.3d 922 [2 Dept. 2012};
`

`Defendant UvHaul’s opposition contends that a question of
`fact exists as to whether this was a “staged ‘accident’”
`(apposition, $15), but does not contest the allegaties that the
`Kemar and Bruce vehicle was hit in the rear by the U-Haul
`‘vehicle. As such, plaintiff‘s and co~defendants' opposition
`papers have failed to-present any non—negligent excuse fer the
`accident
`(see, Plummer v. Nourddine, 83 A.D.3d 1069 {2 Dept.
`2011}; Volpe v. Limoneelli, 74 A.D.3§.795 {2 Dept- 2010]; Paul v.
`Reilly. 29 A-D.3d 626 [2 Dept. 20061; Vlachos v. Saueracker, 19
`sense 683 [2 Dept. 2004]), and have failed to raise a triable
`
`issue of feet to defeat summary judgment (see. Zdenek v- Safetv
`Consultants. Inc., 63 A.D.3d 918 [2 Dept. 2009]).
`
`Accordingly, it is Ordered and Adjudged that defenfiant.
`Kemar aud Bruce’s metion for summary judgment on liability is
`hereby granted? and plaintiif‘s'eomplaint, as against defendants
`Kemar and Bruce, is hereby dismissed.
`
