`job responsibilities for plaintiff, I am familiar with the types of records maintained by BANA in

`connection with the Loan.

`The information in this affidavit is taken from BANA’s business records. I have
`
`personal knowledge of BANA’s proceduresfor creating and maintaining these records,including,
`
`but not limited to, BANA's procedures for creating and maintaining notices mailed in connection
`
`with the Loan. Such business records are: (a) madeat or near the time of the occurrence of the
`
`matters set forth therein by persons with personal knowledge of the information in the business
`
`record, or from information transmitted by persons with personal knowledge; (b) are kept in the
`
`course ofBANA’s regularly conducted businessactivities; and(c)it is the regular practice ofBANA
`
`to make such records. I personally confirmed that the loan informationin this affidavit is accurate
`
`by reading the affidavit and attachments, and checking that the loan information in this affidavit
`
`matches BANA’s on-line records available to me.

`The business records show that this foreclosure action concerns the property
`
`located at 12A Fuller Court, Staten Island, NY 10306 (the Property). The business records also
`
`show that the Loan is evidenced by a promissory note (Note)
`
`executed by Alfred Jones, Jr.
`
`(Borrower) and secured by a mortgage made to Alfred Jones, Jr... True and correct copies of the
`
`note and mortgage are attached as Exhibit 1, and are the business records of BANA. The Bank of
`
`New York Mellon FKA The Bank ofNew York as Successor Indenture Trustee to JPMorgan Chase
`
`Bank, N.A., as Indenture Trustee for the CWABS Revolving Home Equity Loan Asset Backed
`
`Notes, Series 2004-R directly or through an agent, has possession ofthe promissory note. The Bank
`
`of New York Mellon FKA The Bank of New York as Successor Indenture Trustee to JPMorgan

`At the time this action was commenced, The Bank of New York Mellon FKA The Bank of New
`
`York as Successor Indenture Trustee to JPMorgan Chase Bank, N.A., as Indenture Trustee forthe
`
`CWABS Revolving Home Equity Loan Asset Backed Notes, Series 2004-R wasthe holderof the
`
`note and had been assigned the mortgage.
`
`5.

`The note obligates the Borrower to make monthly payments of principal and/or
`
`interest commencing on a date as set forth in the Note (the Monthly Payment).
`
`6.
`
`Accordingto the business records I have reviewed, the Borrower defaulted on the
`
`loan by failing to make Monthly Payments due on June 25, 2021 and continuingto the present. The
`
`unpaid principal balance due on the Loan is $12,750.36 as set forth on the annexed schedule as
`
`Exhibit 2, which is a business record of BANA.
`
`7.

`The business record attached as Exhibit 3 is a notice of default dated
`
`November 29, 2021, that was mailed to the Borrower. According to BANA’s business records I
`
`reviewed, the Borrowerhas not cured the default.
`
`8.
`
`It is BANA’s practice and procedure that, following the borrower’s default and prior
`
`to the commencementofforeclosure proceedings, the borroweris served with a 90 daynotice, in at
`
`least 14 point type, via certified mail, and also by first class mail, to the last know address of the
`
`borrower, and also to the subject premises, if different from the borrower’s last known address.
`
`9.
`
`It is also BANA’s practice and procedure that (1) the borroweris sent all 90 day
`
`notices in a separate envelope from any other mailing or notice BANA sends the borrower; (2) the
`
`90 day notice contains a list of at least five housing counseling agencies as designated by the
`
`Division of Housing and Community Renewalthat serve the region where the borrowerresides.
`

`According to the business records I have reviewed, a 90 day notice, in at least 14
`
`point type, was served via certified mail and also by first class mail, on the dates set forth below,to
