`securing same, plaintiff has declared the debt evidenced by said note due, and there is due thereon $73,117.88,

`together with interest on the account at a variable rate that was 5.500% as of April 03, 2018 and as it may further

`David E. Mantheyis deceased; his date of death was October 27,2018, therefore, he is nolongera
`
`valid title holder and no personal money judgment is sought herein against David E. Manthey. A copy of his death
`
`certificate is attached hereto as Exhibit‘T”.

`SECOND COUNT

`Plaintiff incorporates the allegations of Count One and further states that it is the holder of a mnrtgpge,
`
`a copy of which is attached hereto as Exhibit "B". The mortgage was given to secure payment of the above-described
`
`note, and said mortgage constitutes a valid first lien upon the real estate described in the correct legal description
`
`which is attached hereto as Exhibit "C".
`

`The mortgage was filed for record on October 30, 2006, in Instrument No. 200610301033 of the
`
`county recorder’s records of Cuyahoga County. The conditions of defeasance contained therein have been broken, and
`
`plaintiff is entitled to have said mortgage foreclosed.
`

`Plaintiff says that the defendants herein may claim an interest in the subject property described in the
`
`subject mortgage.
`

`Plaintiff states that the conditions of said Mortgage Deed have been broken, by reason of default in
`
`payment, and that the Mortgage Deed has therefore become absolute; Plaintiff has fulfilled all applicable conditions
`
`precedent; and Plaintiff is entitled to have the equity of redemption, if any, of the Defendants named herein foreclosed,
`
`and to have the subject real property appraised, advertised and sold, and the proceeds arising therefrom applied to the
`
`judgment of Plaintiff.
`

`Plaintiff attaches the Certificate of Merger hereto as Exhibit “D”.

`WHEREFORE, Plaintiff prays to be found to have a valid first lien upon the real estate described
