`PROBABLE CAUSE AFFIDAVIT
`
`The undersigned, of lawful age, being duly sworn, upon oath deposesand states asfollows:
`
`1. Sgt. Paul Priegel is a CLEET certified Police Officer employed by the Stillwater Police Department.
`
`2. Sgt. Paul Priegel has conducted an investigation and based on the knowledge gained from that
`investigation of the circumstances, it appears as follows:
`
`Ismael Espino, Jr. was arrested at 12" and Duncan on 02-18-2017 at approximately 0426hours. He was
`arrested because:
`
`On Saturday, 02-18-2017 at approximately 0417 hours, | stopped a 2013 black Ford Focus
`bearing California tag 6VGT003at 12" and Duncan.
`| madethis traffic stop after | observed the driver
`improperly back in the intersection of 12" and Main, drive westboundin the eastbound lanesoftravel
`from Main on 12" all while not having any headlights on.
`Thedriver was identified as Ismael Espino, Jr. When | contacted Ismael, | could smell a strong
`odorof an alcoholic beverage coming from inside the vehicle, | could see Ismael had a slumped posture,
`his clothing was disheveled and his speech wasslurred.
`| could also see a bar stamp for “Outlaws” on
`Ismael’s right hand.
`| asked Ismael to step from the vehicle where he agreed to submit to the
`standardizedfield sobriety test battery.
`Ismael was very unsteady on his feet and the odor of an alcoholic beverage was very strong upon
`Ismael’s breath and person when hespoke. Ismael performed very poorly on the SFST Battery. Based
`on my observations,| believed Ismael had been operating a motor vehicle upon a public roadway while
`underthe influence of alcohol.
`| arrested Ismael at approximately 0426 hours.
`Atthe jail, | read Ismael the Implied Consent and he said “yeah” when askedif he would take the
`State’s Breath Test. Ismael’s test result was .16 g/210 L alcohol concentration.
`
`The aforementioned offense(s) occurred in Payne County, Oklahoma.
`
`WHEREFORE, based onthe aboveinformation, your Affiant prays the Honorable Court find that
`probable cause exists to detain Ismael Espino, Jr. on the following charge:
`
`1. Aggravated DUI 47-11-902D (a misdemeanoroffense.)
`
