`As shown in the attached email, we offered two dates: April 9th and 17th. We contacted you on April 15‘, even before
`we filed our reply, to offer you the opportunity to depose our declarant on these dates. Since then we reached out to
`you several additional times in an effort to elicit an answer to whether you intended to proceed with the deposition. At
`this juncture — six days prior to the second of the offered dates — you have still not confirmed whether you intend to
`proceed, sent out the required deposition notice, or proposed alternative dates. The rules require 10 days notice and
`we, as an accommodation, allowed you until noon six days prior to the offered date. Having received no deposition
`notice, confirmation or counterproposal, Dr. Morton is no longer being offered for deposition on the 17th.
