`Patent Owner requests authorization to submit video excerpts of the
`
`April 28, 2015 deposition testimony of Dr. Leonard Forys. According to
`
`Patent Owner, these excerpts are relevant in assessing the demeanor and
`
`credibility of Dr. Forys in a way that is not reflected in the written transcript.
`
`Petitioner opposes Patent Owner’s request.
`
`The rule under 37 C.F.R. § 42.53(a) states that parties may agree to
`
`video-recorded testimony, but may not submit such testimony without prior
`
`authorization of the Board. In addition, the Board may authorize or require
`
`live or video-recorded testimony. See 37 C.F.R. § 42.53(a).
`
`We authorize Patent Owner to submit no more than twenty (20)
`
`minutes of video excerpts of the April 28, 2015 deposition testimony of
`
`Dr. Leonard Forys within five (5) business days of this Order. Petitioner is
`
`authorized to submit no more than twenty (20) minutes of video excerpts
`
`from the same deposition within five (5) business days of Patent Owner’s
`
`video excerpt submission, should Petitioner so choose.
`
`All video excerpt submissions must be made using the Patent Review
`
`Processing (PRPS) system. Only MPEG format video files (MPEG, MPG,
`
`MP1, MP2, MP3, M1A, M2A, M1V, MPA, MPV) may be uploaded in
`
`PRPS. Password-protected files will not be accepted. A single uploaded file
`
`may not exceed 25 megabytes in size. For technical reasons, PRPS is unable
`
`to accept files over 25 megabytes at this time. The parties are encouraged to
`
`reduce the file size by splitting a large file into multiple smaller files. The
`
`parties are directed to address all questions related to video excerpt
`
`submission issues to Frances Han at (571) 272-4612.

`Accordingly, it is
`
`ORDERED that Patent Owner is authorized to submit no more than
`
`twenty (20) minutes total of video excerpts of the April 28, 2015 deposition
`
`testimony of Dr. Leonard Forys within five (5) business days of this Order;
`
`FURTHER ORDERED that Petitioner is authorized to submit no
`
`more than twenty (20) minutes total of video excerpts from the same
`
`deposition within five (5) business days of Patent Owner’s video excerpt
`
`submission; and
`
`FURTHER ORDERED that all video submissions to the Board must
`
`be made using the PRPS system.
