`The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the

`basis for the rejections under this section made in this Office action:
`
`A person shall be entitled to a patent unless -
`
`(e) the invention was described in (1) an application for patent, published under section l22(b), by another filed
`in the United States before the invention by the applicant for patent or (2) a patent granted on an application for
`A patent by another filed in the United States before the invention by the applicant for patent, except that an
`international application filed under the treaty defined in section 351(a) shall have the effects for purposes of this
`subsection of an application filed in the United States only if the international application designated the United
`States and was published under Article 21(2) of such treaty in the English language.

`5 Claims 1-25 are rejected under 35 U.S.C. 102(e) as being anticipated by Veres et al. (U.S.
`
`Patent No. 6614790 B 1).
`
`- With respect to claim 1, 6, 8-9, 11, 16, 18-20, and 22-25, Veres teaches a method of
`
`processing queued data packets in a packet dataxcommunicatiion system (e.g. the switch in Fig.
`
`3), the method, comprising the step of: allocating a tier of service for substantially each of a
`
`plurality of individual packet data queues (e.g. P to Pn and 'Pn+1 to Pm+l in Fig. 4 shows the
`
`priority level buffer for each data); wherein the method is characterised by the steps of:
`
`determining a total number of data packets that can use an available communication resource
`
`(see col. 4,lines 55-60); allocating a proportion of said total number of data packets to a number
`
`of the tiers of service to allow individual packet data queues on a number of tiers to share a
`
`communication resource (see col. 6, lines 28-32); and providing said communication resource to
`
`queued packet data users on a tier-by-tier basis, such that said communication resource is made
`
`available to a substantial number of tiers (see col. 6, lines 41-44).
`
`- With respect to claims 2, 4, and 12, Veres also teaches wherein said step of allocating a
`
`proportion of a total number of data packets is further characterised by the step of: providing a
`

`. commitment that a proportion of an entire communication system bandwidth will be allocated, to

`users operating on a particular tier (e. g. the service guarantees for each flow as col. 6, lines 38- _

`- With respect to claims 3, and 133, Veres teaches the method further characterised by the
`step of: allocating different weights to each tier of service to provide a differential level of
`
`service in the allocation of said communication resource between said tiers (e.g. different priority
`
`levels as Fig. 4 shows).

`- With respect to claims 5, 7, 15', and 17 Veres discloses the method further characterised
`
`by the step of: providing a packet data user with an identification code to assist in the tier
`
`allocation step, wherein, for example, the identification code provides an identifier for theluser
`and/or an indication of a number of data packets that the user wishes to transfer (col. 4, lines 16-
`
`18).
`
`- With respect to claim 10, Veres teaches the method further characterised by the step of:'
`
`determining a tier of service for each user when a packet data session for each user commences,
`
`(block 4 in Fig. 4).
`
`- With respect to claim 14, Veres teaches wherein said means for allocating a proportion
`
`of a total number of data pacl<ets allocates data packets using rate allocating‘ service disciplines
`
`(e.g.,col. 1, lines 33-35).

`- With respect to claim 21, Veres discloses wherein said communication unit operates as
`
`a gateway to and/or from two packet data networks (e. g. the switch in Fig. 3).
